BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: April 21, 2015 TO: Honorable Chairman and Members of the Board FROM: James Puckett SUBJECT: Lease - Former FWB Hospital - Elder Services DEPARTMENT: Facility Maintenance BCC DISTRICT: 2 STATEMENT OF ISSUE: Consideration of an amended 10 year lease with the Okaloosa County Council on Aging (Elder Services) for space in the former Ft. Walton Beach Hospital. The annual fee shall be one dollar ($1.00). BACKGROUND: On October 7, 2014 the Board of County Commissioners approved the space allocation for both the Council on Aging (Elder Services) and Okaloosa Walton Homeless Continuum of Care (Opportunity Inc) and directed leases be prepared to reflect the terms and conditions for the use of the approved space by the respective lessees. The County Attorney's office prepared the amended lease (attached) for Elder Services of which Exhibit "A" depicts the boundary of the leased area. Lease Area "A" is where the lessee has occupancy rights and Common Area Maintenance "A" is where the lessee has exclusive maintenance (custodial services, carpet cleaning, and decorating) responsibilities. As this facility lease adjoins the lease with Opportunity, Inc a single, dimensioned floor plan depicting the lease areas is included with each document. As directed by the board, staff facilitated an agreement regarding the portion of utilities bills for which Opportunity, Inc would reimburse Elder Services; this agreement is included as exhibit "B" to the lease. This agreement will be reviewed annually in October and the amount shall be adjusted to reflect any changes in these costs if warranted. In addition to the space originally approved by the Board on October 7, 2014, Elder Services has requested that they be allowed to utilize two (2) portable storage buildings that are located in the parking lot of the old hospital and that they be allowed to maintain use of the office space east of the main entrance. Staff has no objections to the office space as Elder Services has historically been utilizing the area and has identified the additional space request in Exhibit A. With respect to the portable storage buildings, these items are property of Elder Services and have been located on site for some time. In accordance with the Lease, this is not permitted without written consent of the Lessor. A letter of approval has been prepared and approved by the County Attorney. Staff has no objection to the existing buildings remaining, this provision within the lease clarifies that no additional items be placed without express permission from the County. OPTIONS: Approve/Disapprove the proposed lease with Elder Services to utilize space in the former Ft. Walton Beach Hospital. RECOMMENDATIONS: Approve an amended 10 year lease with the Okaloosa County Council on Aging for space in the former Ft. Walton Beach Hospital as indicated on Exhibit "A". The lease areas included are identified as Lease Area "A" along with Common Area Maintenance "A" as indicated on Exhibit "A" at an annual lease rate of $1.00/year and for the Board to authorize the Chairman to execute all necessary documents.
