BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: December 1, 2015 TO: Honorable Chairman and Members of the Board FROM: Jeff Littrell SUBJECT: Arbennie Pritchett WRF Expansion - Approval of Design Build Agreement with CDM Constructors, Inc. DEPARTMENT: Water and Sewer BCC DISTRICT: All STATEMENT OF ISSUE: Okaloosa County Water & Sewer (OCWS) and Purchasing staff request the Board of County Commissioners (BCC) approval for the Chairman to execute the Design Build Agreement (and any attachments) with Camp Dresser & McKee Constructors (CDM Constructors, Inc.), (a wholly owned subsidiary of CDM Smith) for the Arbennie Pritchett Water Reclamation Facility (APWRF) Expansion Project, in response to RFQ and RFP #WS 01- 15. BACKGROUND: On 7/21/2015, the BCC authorized the opening of CDM Smith's cost proposal envelope and also authorized staff to negotiate a contract to bring back to the BCC for approval and execution. That past agenda request is attached for your review. It, along with two other past agenda requests, serves to document and summarize the design-build procurement process, project need, funding, and other background information. Soon after the 7/21/2015 BCC meeting, CDM Smith's cost proposal envelope was opened up, with an initial price of $13,460,832 for the 5 million gallon per day (MGD) plant expansion. Staff has since negotiated the price and resulting Design Build Agreement to achieve a lump sum amount of $12,480,704, for an overall savings of $980,128. Additional savings will be realized by using Owner Purchased Equipment materials procurement which produces significant savings through the avoidance of sales taxes. Our estimates predict sales tax savings of over $250,000. The attached Agreement has been a fully coordinated effort by OCWS, Constantine Engineering, Purchasing, and the County Attorney's legal staff. The Agreement is attached for your review and consideration, along with the County Contract Review Coordination Sheet. The final conformed set of contract documents is quite large. The majority of the documents listed in the Table of Contents are attached as pdf files to this agenda request. The last four items listed in the Table of Contents are very large file sizes and are available through the attached web link. Funds are available for the APWRF Expansion Project, which is budgeted at $13M. The project is funded completely with allocated capacity expansion charges that were saved over the past few years in a self-restricted reserve account. In the attached FY2016 budget, $11M is listed for the project. Funding from the FY2015 budget will need to “roll over” into FY2016 and future fiscal years to reach final completion of the project. OPTIONS: Approve or deny. RECOMMENDATIONS: Water & Sewer and Purchasing staff recommend BCC approval to authorize the Chairman to execute the Design Build Agreement (and any attachments) with CDM Constructors, Inc. for the APWRF Expansion Project, at a lump sum amount of $12,480,704.00. RECOMMENDED BY: APPROVED BY: John Hofstad, County Administrator
