BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: August 2, 2016
TO: Honorable Chairman and Members of the Board
FROM: Jason Autrey
SUBJECT: Public Hearing for Resolution setting assessments for Falcon Way and
Eagle Way
DEPARTMENT: Public Works
BCC DISTRICT: 1
STATEMENT OF ISSUE: On February 16, 2016, the Board created the Pines and Triple
Lake Municipal Service Benefit Unit for road improvements. A sufficient number of petitions
have been received for the improvement of Falcon Way and Eagle Way within the MSBU. On
June 21, 2016, the Board adopted the Preliminary Assessment Resolution to impose the
assessments to fund the construction of the roads. The Final Assessment needs to be approved to
actually levy the assessment against the benefited properties so that the improvements may
proceed.
BACKGROUND AND ANALYSIS: Various property owners within the Pines and Triple
Lakes subdivision in northern Okaloosa County have sought the assistance of the County in
obtaining paved roads in their subdivisions. Many have submitted petitions under the County’s
MSBU policy to create an MSBU and obtain the paving of their roads. Subsequently the Board
created the MSBU and the County has received a sufficient number of petitions to improve two
roads within the Pines and Triple Lakes subdivision. Those are Falcon Way and Eagle Way.
As contemplated, each property owner will pay their fair share of the actual cost of the
improvement of their road over a period of years as an assessment against the property. The
assessment will be collected annually on the ad valorem tax bill. The initial step in this process
was the adoption of a Preliminary Assessment Resolution which established the proposed rate
for the assessment and scheduled a public hearing for the adoption of a Final Assessment
Resolution which will actually impose the assessment. The Preliminary Assessment Resolution
was approved by the Board on June 21, 2016. Pursuant to the Preliminary Assessment
Resolution, published and individual mailed notice was provided to each property that would be
subject to the assessment.
The proposed cost of the improvement would be financed over a period of fifteen (15) years and
paid annually by the property owner. Only those properties which abut the road being improved
would be subject to the assessment. It is anticipated that the cost per year will be $528.26 which
includes the cost of construction, interest and cost of collection. The property owner has the
opportunity to prepay the assessments and avoid the interest and cost of collection. The
prepayment amount will be $5,536.54.
The actual assessments for the improvements are imposed through the adoption of the Final
Assessment Resolution which is presently before the Board. The assessments, if imposed by the
Board, will first appear on the November 2016 tax bill.
OPTIONS: Approve/Disapprove.
RECOMMENDATIONS: Approve the Final Assessment Resolution imposing special
assessments to fund construction of road improvements on Eagle Way and Falcon Way.
