proximity to the subject parcels. The owners need to develop the subject parcels in a similar manner to
those of the surrounding parcels so that the residential areas will be similar in orientation and density,
while providing for similar land uses and population densities. There are multiple existing residential
subdivisions within a one-mile radius the subject parcels which have a Future Land Use Designation of
Low Density Residential. This proposed change to the Comprehensive Plan Future Land Use Map
Designation for these subject parcels will allow the owner to construct improvements to the properties
which are consistent with the surrounding properties. Once the Future Land Use Map Designation is
changed, the owner will be able to design a subdivision with comparable homes (and price ranges) as
those in the adjacent subdivisions.”
6. The amendment will not promote or result in urban sprawl as that term is defined in
ss163.3177(6),(a),9, Fla. Stat. A finding by the State Land Planning Agency that an amendment will result
in urban sprawl shall constitute a rebuttable presumption that the amendment will promote or result in
urban sprawl.
Response: After review of the criteria specified in ss.163.3177(6),(a),(9) it is staff opinion that the
amendment will not promote or result in urban sprawl.
7. Facilities and services including roads, water, sewer, recreation, drainage, and public safety are
adequate to support the level of development enabled by the amendment, or that mitigation in the
form of improvements or compensation can be provided to offset negative impact.
Response: Of the facilities and services listed only roads and water supply might be of concern. Staff
contact with County Public Works indicated that any road impact would be addressed by mitigation at
the time of development review. Water is supplied by Auburn Water System which indicated that
adequate water supply in not a problem.
8. The amendment will not result in damage to or destruction of valuable natural resources as described
in the Conservation Element of this Plan.
Response: Ponds and wetlands are present on the amendment site. As stated by the applicant “The
proposed amendment will not result in damage to (or destruction of) existing valuable natural resources.
As a matter of fact, the existing ponds and wetland areas will be preserved and incorporated into natural
green space areas within the proposed residential area, and they will be accessible to anyone who
desires to enjoy their amenities.”
9. The amendment will not conflict, interfere with, or contradict infrastructure plans of the county, or
other government agency, or public utility; or otherwise create a physical liability for the county,
government agency, or public utility.
Response: Review of the County’s capital improvements program indicates the proposed amendment
meets this criteria.
10. The amendment will generally result in a net public benefit as opposed to a public liability.
Response: Based on analysis of the preceding the amendment will satisfy this criteria.

BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: May 6, 2014
TO: Honorable Chairman and Members of the Board
FROM: Elliot Kampert
SUBJECT: LPA 02-14 Comprehensive Plan Amendment
DEPARTMENT: Growth Management
BCC DISTRICT: 5
PUBLIC HEARING: Consideration of a request Submitted by the Department of Growth
Management for an amendment to the text of the Comprehensive Plan, Future Land Use
Element, adding new Policy 10.20 relating to establishing the Mid-Bay Regional Activity Center
as an overlay to the Future Land Use map. TRANSMITTAL HEARING FOR STATE
AGENCY REVIEW.
STAFF FINDINGS: The 187.1 acre Mid-Bay Regional Activity Center (RAC) was approved
by the Board of County Commissioners on September 12, 2000, based on findings that the then-
vacant land was suitable for high-intensity development, and was served by adequate existing
and planned infrastructure. The RAC is bounded on the north by Choctawhatchee Bay, on the
east by the Regatta Bay subdivision, on the south by US Highway 98, and on the west by State
Road 293, Destin Middle School, and the previously permitted Mid-Bay Marina DRI.
On February 18, 2014 the Board of County Commissioners (BCC) approved a boundary change
for the RAC as described in Ordinance No. 14-06. As part of the approval a follow-up
Comprehensive Plan text amendment was required to authorize the location of the RAC on the
Future Land Use Map as specified in Ord. No. 14-06. In this regard, a new Future Land Use
Element Policy 10.20 is proposed as follows.
Policy 10.20 The Mid-Bay Regional Activity Center (Mid-Bay RAC) shall be illustrated as an
overlay on the Okaloosa County Future Land Use Map and will include the approximately 209.8
acres depicted and described in Ordinance 14-06. All development within the Mid-Bay RAC
shall be consistent with the underlying Future Land Use Map and zoning designations and
subject to the provisions of Chapter 380.06(2) (e), F.S., Rule 28.24-014, F.A.C., and Policy
10.19 of the Future Land Use Element of the Okaloosa County Comprehensive Plan.
PUBLIC COMMENT/OPPOSITION: None to date.
PLANNING COMMISSION: The Planning Commission voted unanimously to recommend approval at
a public hearing held April 10, 2014.
MILITARY REPRESENTATIVE: No comment.
STAFF POSITION: Staff supports the requested text amendment.
Packet Pg. 33
RECOMMENDATION: It is recommended that the Board consider the facts presented herein, as well
as any facts that may be presented at the public hearing, and then decide whether or not to approve the
text amendment for state agency review.
