BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: November 3, 2015 TO: Honorable Chairman and Members of the Board FROM: Roland Sims Jr. SUBJECT: Public Hearing Request - County Administrator Ordinance DEPARTMENT: County Administrator BCC DISTRICT: All STATEMENT OF ISSUE: In 1993, the Board adopted a County Manager’s Ordinance pursuant to the provisions of section 125.74, Florida Statutes. That statutory provision is an optional approach to the establishing of the powers and duties of a county’s chief administrative officer. The original ordinance contains numerous provisions that need to be amended to bring them in line with current law and practice. Further, there are several provisions that require clarification to make them consistent with other policies of the Board. BACKGROUND AND ANALYSIS: As part of the Board's established annual goals, staff was directed to begin reviewing existing ordinance provisions to determine whether any revisions or clarifications were required. One of those ordinances was the County Manager Ordinance which was adopted by the then Board in 1993. That Ordinance requires various modifications to address changes that have occurred over the years. For example, the Ordinance created the position of County Manager but over the years, the name of the position has been changed to “County Administrator”. Additionally, there are provisions that currently require clarification including the interrelation between the powers of the County Administrator and the administration of the Boards policies. Finally, to provide the Board the maximum flexibility in the addressing of the powers of the County Administrator in the future, it is recommended that the Ordinance be adopted pursuant to the Boards “Home Rule” powers rather than the more narrow provisions of section 125.74, Florida Statutes. OPTIONS: Approve/Disapprove. RECOMMENDATION: Authorize the scheduling of a public hearing for the adoption of an amendment to the County Administrator’s Ordinance.
