Mr. Parisot stated the requests for ratification are happening too often. He questioned why people are not getting their documents on the agenda in time. Mr. Parisot felt approval of the documents should be by the entire Board and not one individual commissioner. He pointed out this agenda request is not only to ratify the Chairman’s signature on this amendment but to authorize him to execute all future grant documents during the term of the grant. The lecation of the subtect property on an aerial following staff findings were giver: 4 * * The proposed PLUM amendment is classified as a Type-1 plan amendment which involves properties ten acres or more in size, Type-L amendmants must be transmitted to the State for state agency review. e The current RR FLOM category permits single-family dwellings and related uses at an allowable density of two units to the acre. This density would allow up to 388 single - came? dwellings on the amendment site. ® The proposed LOR FIM categqary permits single-family dwellings - and related uses at an allowahle density of four units ta the acre. This density would allow up to 777 Single-family dwelling units on the amendment site. ® Evaluation quidelines and criteria for Type-1l amendments are specified ain the Comprehensive Plan, Administration Elament, Policy 2.iS. Mo. Kampert expounded on the functional relationship of the subject property to other more densely or intensely designated or developed lands; the consistent character of the proposed density established by the outward growth of the City of Orestview. He said hecausea there is no mistake in the plan, the October 7, 2014 ~G~ Minute Book 72, Page 6 Okaloosa County Hoard of County Commissioners justification for the amendment is demonstrated by an aerial photograph which shows existing subdivisions south of I-10 are substantially built out. e The amendment site is located within the Eglin North Encroachment Zone which necessitates review and comment by the county’s military representative. The site is not within the critical approaches or accident potential zones associated with Camp Rudder as identified in the Eglin Joint Land Use Study. e The applicant provided a letter dated January 23, 2014, from a local realtor indicating a need for building lots in the .25 acre to .35 acre size in the area south of I-10. Attached to the letter is data from market Graphics Southeast which shows demand for new homes in market area MG 23 which is North Okaloosa County. However, according to department records there have been 76 new subdivisions approved in the MG 23 area from 2004-2013 with a total of 5,506 building lots. e The Board approved this amendment for transmittal for state agency review on July 1, 2014. No objections were raised by an agency as a result of review. Mr. Kampert stated the Planning Commission voted unanimously to recommend approval at a public hearing held June 12, 2014. There were no comments from the public or from the military representative. He said staff has no objection to the proposed amendment. Questions were posed by the commissioners about the road serving the property, traffic concurrency, and the impact on the school system. Mr. Boyles noted there are challenges to be faced regarding the landfill and borrow pits in the area. He then made motion, seconded by Mr. Harris, to approve the requested amendment to the FLUM designation as advertised. 5 yeas. ORDINANCE NO. 14-14 PUBLIC SAFETY - OKALOOSA ISLAND FIRE DISTRICT INTERLOCAL AGREEMENT Mr. Windes reported this item has been removed = from consideration. October 7, 2014 -7T- Minute Book 72, Page 7 Okaloosa County Board of County Commissioners WATER & SEWER - USING CIP FUNDS “FREED UP” BY GRANT IN LIEU OF A RATE ADJUSTMENT Mr. Jeff Littrell, Water & Sewer System Director, stated staff does not believe use of CIP funds freed up by grant money in lieu of the scheduled October 1 rate adjustment is appropriate. He said grant funds are always projects specific and diverting a large number of dollars into the rate model in lieu of the revenue from the scheduled FY 2015 rate adjustment is problematic. Mr. Littell said he believes it is critical that the department always use grant opportunities to increase the funding to address the critically-aging infrastructure issues. He reiterated the intent of grants for capital projects is not to divert funds from infrastructure projects to operations and maintenance (O&M) expenses. Mr. Littrell stated staff strongly recommends that windfall grant opportunities for Water & Sewer be used for aging infrastructure projects. Mr. Parisot stated in 2011 when the five-year rate structure was approved (Ordinance No. 11-12), the commissioners, “three of whom are still sitting on the Board,” made a commitment to rate users that the rate structure would be reviewed each year as part of the budget input. He said that part of the budget was not done and now the department says use of those freed-up grant funds to reduce the rate is inappropriate. Mr. Parisot stated the commissioners owe it to the customers to review this, saying they are accountable when they make commitments. Continuing, Mr. Parisot was of the opinion the annual analysis in September was poorly done. He said the rate structure was not included as part of the agenda item and he still does not know the impact. Mr. Parisot told the department head he must give the Board an opportunity to look at the impacts. Mr. Boyles asked Mr. Parisot exactly what he was looking for in the analysis he requested. Mr. Parisot answered he has not seen the document prepared by Burton and Associates (consultant). He also stated that previously the Board waived rate increases for FY 2010 and FY 2011. Mr. Boyles stated the idea of seeking grant funds is not to offset the O&M costs of our program. He said grant funds should be used to accelerate the capital projects. Mr. Boyles stated the five-year plan is for advance planning and not an annual knee-jerk process. He added that he has heard no comments from the citizens on the rates. October 7, 2014 -8- Minute Book 72, Page 8 Okaloosa County Board of County Commissioners Mr. Harris said an assessment every year is a compelling argument but he feels grants should be used for their designated purpose and not to play a shell game. He stated he agrees with Mr. Boyles and does not feel any action is needed. Mr. Amunds commented about the department head walking the hall to discuss most items and feels he should let the commissioners know how well the five-year plan is doing. He said integrity is important and he understands what Mr. Parisot is saying; however, he feels a grant given for a specific reason should be used for that purpose. Mr. Littrell stated staff prepares a Revenue Sufficiency Analysis each year. He advised the consultant comes in and it is reviewed with staff. Mr. Littrell said the budget is prepared each year with the understanding this analysis is performed. Mr. Windes stated the consensus of the Board is to take no action. WATER & SEWER - FDEP GRANT AGREEMENT FOR OKALOOSA ISLAND/WRIGHT AREA GRAVITY SEWER REHAB PROJECT Mr. Littrell stated this project was made available by a line item appropriation by the Legislature. It is a Florida Department of Environmental Protection (FDEP) grant in the amount of $450,000 for the Okaloosa Island/Wright Area Gravity Sewer Rehabilitation Project. Mr. Amunds made motion, seconded by Mr. Boyles, to authorize the Chairman to execute the grant documents. 5 yeas. PURCHASING - RECOMMENDATION TO AWARD BID FOR TANGLEWOOD/ OVERBROOK STORMWATER IMPROVEMENT PROJECT Mrs. Zan Fedorak, Purchasing Manager, stated three bids were received on September 11, 2014, for the Tanglewood/Overbrook Stormwater Improvement Project. AIRPORTS - REQUEST TO SOLICT BIDS FOR CONSTRUCITON OF THE AIRCRAFT RESCUE AND FIRE FIGHTING FACILITY ON EAFE Mr. Harman requested approval to solicit bids for the construction of the Aircraft Rescue and Fire Fighting Facility {ARFF) on Northwest Florida Regional Airport. Base utilities servicing the proposed location were insufficient and the project architectural engineering firm had to revise the plans and specifications, Although the Board approved the award of the contract for this project to Birkshire, Inc. in December 2013, there were concerns about the low bidder’s ability to perform and deliver the project on schedule. Mr. Harman said they did not feel it was in the best interest of the county to issue a Notice to Proceed but instead to rebid the project. Mr. Harris made motion, seconded by Mr. Parisot, to approve the recommendation of the department head and to advertise for bide on this project. 5 yeas.
