Dear Mr. Windes:
This letter is to request a right-of-way vacation for a portion of a 20 foot alley and a portion of First
Street between lots in the Silver Beach subdivision.
In the early 1990's, the Silver Beach subdivision was all property owned by Bernie Henderson.
When the property was sold to several buyers, everything except these two small pieces was
vacated. In fact, a survey from 1994 when my family bought the property showed these portions
as vacated, which we always assumed was the case until recently.
In planning to sell the property, the titie company discovered that these two pieces had never been
properly vacated, and without this, we can't move forward with the sale. The neighboring owner is
The Track, and they are also interested in having this done, as they use the First Street portion as
an entrance into their complex.
The legal description of the property in question is on the attached survey, and is:
