BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: January 5, 2016 TO: Honorable Chairman and Members of the Board FROM: Jason Autrey SUBJECT: Request to schedule a public hearing to vacate a portion of Marler Dr. on Santa Rosa Island DEPARTMENT: Public Works BCC DISTRICT: 2 STATEMENT OF ISSUE: Mr. Shaul Zislin of FWGV, LLC, represented by Preble-Rish, Inc., requested a Public Hearing to vacate a portion of Marler Drive located on Santa Rosa (Okaloosa) Island. The BCC approved an agreement with the petitioner at the November 17, 2015 meeting to provide a 60 day due diligence period for the developer to pursue all necessary permits, licenses, and exceptions. The developer has notified the County that they wish to move forward with the Petition to vacate. BACKGROUND: The Santa Rosa Island Subdivision was platted and accepted by the Board of County Commissioners on April 12, 1958. Mr. Shaul Zislin of FWGV, LLC, desires to construct a restaurant with the potential for additional future development on a single parcel by combining several lots and vacated right-of-way. The agreement requires the petitioner to pay $110,000.00 to Okaloosa County and to construct a public boardwalk along the north side of the property that will connect to Marler Park at no expense to the County in exchange for the vacated right of way. The vacation request includes a release, by Okaloosa County, of the right-of-way conditions and stipulations as would otherwise apply to vacated property. The vacated right-of-way could then be built upon and utilized as additional property owned by the petitioner for purposes of density calculations and floor area ratio. The petitioner has granted the Okaloosa County Water and Sewer Department a utility easement to accommodate the Petitioner's proposed use of the property. Relocation of existing utilities would be performed by the developer at no expense to the County and coordinated through a subsequent development submittal review. OPTIONS: Approve/Disapprove the request to schedule a Public Hearing to consider the right- of-way vacation request. RECOMMENDATIONS: Approve the request to schedule a Public Hearing to be held during the regularly scheduled Board meeting on January 19, 2016.
