BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: September 15, 2015 TO: Honorable Chairman and Members of the Board FROM: Jason Autrey SUBJECT: Request to schedule a public hearing to vacate a portion of Marler Dr. on Santa Rosa Island DEPARTMENT: Public Works BCC DISTRICT: 2 STATEMENT OF ISSUE: Mr. Shaul Zislin of FWGV, LLC, represented by Preble-Rish, Inc., requests a Public Hearing be scheduled to vacate a portion of Marler Drive located on Santa Rosa (Okaloosa) Island. The petitioner proposes a payment of $110,000.00 to Okaloosa County for the right-of-way vacation along with the construction of a public access boardwalk along the north side of the property, which is along the south edge of the Santa Rosa Sound. The proposed boardwalk will connect to Marler Park. BACKGROUND: The Santa Rosa Island Subdivision was platted and accepted by the Board of County Commissioners on April 12, 1958. Mr. Shaul Zislin of FWGV, LLC, desires to construct a restaurant with the potential for additional future development on a single parcel by combining several lots and vacated right-of-way. The petitioner proposes a payment of $110,000.00 to Okaloosa County and to construct a public boardwalk along the north side of the property that will connect to Marler Park at no expense to the County in exchange for the vacated right of way. The vacation request includes a release, by Okaloosa County, of the right-of-way conditions and stipulations as would otherwise apply to vacated property. The vacated right-of-way could then be built upon and utilized as additional property owned by the petitioner for purposes of density calculations and floor area ratio. The petitioner requests Okaloosa County vacate utility easements on and under Marler Drive in favor of relocated easements to be determined later to accommodate the Petitioner's proposed use of the property. Relocation of existing utilities would be performed by the developer at no expense to the County and coordinated through a subsequent development submittal review. OPTIONS: Approve/Disapprove RECOMMENDATIONS: Approve the request to schedule a Public Hearing to be held during the regularly scheduled Board meeting on October 20, 2015.
