STATEMENT OF ISSUE: Staff requests Board approval to terminate the Lease Agreement
with Joe’s Upholstery at 1310 F Oddfellow Road, Fort Walton Beach, FL 32547. (This unit is
located in a building owned by Water & Sewer (WS), abutting the west side of the rear parking
lot of the WS Administration Building.)
BACKGROUND: WS purchased two (2) buildings on the east side of Oddfellow Road in 2006,
and until June 30, 2016 had five (5) tenants in these units whose annual payments totaled
$32,742.00 (includes sales tax). Staff has made notice to the public generally that space is
available via the WS website.
Lease #L07-0282-WS with Joe’s Upholstery commenced on November 1, 2006 and was
scheduled to terminate on September 30, 2016. A copy of the current lease is attached. Annual
rent for this unit has been $5,088.00, payable as 12- $424.00 monthly payments. On June 10,
2016 Joseph E McKenzie (Joe) submitted the attached document requesting to terminate his
lease effective 6/30/16. This request was for personal reasons and included the need for Joe to
provide full time care for a family member. Joe has been a “model tenant” since WS purchased
these units in 2006. Although the lease does call for a 60 day notification to terminate by the
lessee, staff feels that based on the circumstances we should grant Joe’s request and terminate the
lease as of June 30, 2016. All rent payments have been received through June 30, 2016 and the
premises have been inspected and left in excellent condition. This termination has received
guidance by legal staff.
OPTIONS: Approve or deny the request to terminate the lease with Joe’s Upholstery, effective
