RESOLUTION NO. 2015- A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF OKALOOSA COUNTY FLORIDA AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY; APPROVING THE PURCHASE AND SALE AGREEMENT; APPROVING AND AUTHORIZING THE CHAIR OR VICE CHAIR, OR THEIR DESIGNEE, TO EXECUTE CLOSING DOCUMENTS; PROVIDING GENERAL AUTHORITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Chapter 125 Florida Statutes and the constitutional home rule powers of Okaloosa County authorize the County to acquire and convey real property; WHEREAS, the County’s Water & Sewer Department plans to construct a 1 million gallon elevated water storage tank and has determined that property located along the east side of Highway 85 North approximately 800 feet south of Phil Tyner Road is a desirable location to construct the project; WHEREAS, the owners of the property desire to sell, and the County desires to buy, a 220- foot by 220-foot square parcel as more specifically set forth in Appendix “A” attached hereto (the “Property”) for use in constructing and operating said water tank, together with pipeline and ingress and egress easements over contiguous property of the owner; and WHEREAS, the Property has been appraised by an independent appraiser and the purchase price reflects the appraiser’s opinion of value. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF OKALOOSA COUNTY FLORIDA: 1. The recitals set forth above are true and correct and are incorporated into this Resolution. 2. The Purchase and Sale Agreement between the County and Thomas B. Horne, III, Dallas Briscoe Horne, Barbara Beth Horne and Daniel Gene Horne for the acquisition of the Property and attached hereto as Appendix “B” (“Agreement”), is hereby approved. The Chair or Vice Chair, or their designee, is hereby authorized to execute the Agreement. 3. The Chair or Vice Chair, or their designee, are hereby authorized and directed to execute and deliver all documents, papers, certificates, and instruments and take all actions necessary and proper to effect the acquisition of the property described in the Agreement including, but not limited to, execution of closing documents. 4. The Chair and County staff are hereby authorized to do all acts and things required, consistent with this Resolution and the Agreement, for the full, punctual and complete performance of all requirements of the Agreement and this Resolution. The Vice Chair, or a designee of the Chair or Vice Chair, is authorized to do all things required of the Chair by this Resolution in his absence or unavailability. 5. This Resolution shall be liberally construed to effect the purposes hereof and shall take effect immediately upon its adoption.
