PUBLIC HEARING - ORDINANCE AMENDING CHAPTER 2 OF LAND
DEVELOPMENT CODE RELATING TO ACCESSORY USES AND STRUCTURES
Mr. Stanford read the advertised legal notice for public hearing
to amend Ordinance No. 91-01, the Land Development Code, as
submitted by the Growth Management Department to revise Chapter
2, Section 2.21.00 “Accessory Uses and Structures,” Subsection
10 “Livestock; Poultry; Beekeeping.”
Mr. Kampert termed this a housekeeping item, stating the
Legislature amended Section 586.10, Florida Statutes, to read:
The authority to regulate, inspect, and permit managed
honeybee colonies and to adopt rules on the placement
and location of registered inspected managed honeybee
colonies is preempted to the state through the depart-
ment and supercedes any related ordinance adopted by
a county, municipality, or political subdivision.

Further, from Section 586.045, Florida Statutes:
Fach beekeeper having honeybee colonies with the
state shall apply to the department, on forms
supplied by the department, for certificates of
inspection and registration, and for annual re-
newal on the anniversary date of the registration.
An application fee for renewal postmarked after
the anniversary date shall be accompanied by a
$10 late filing fee.
Mr. Kampert clarified these regulations mean the Department of
Agriculture will control beekeeping. He advised this is the
first of two hearings on the issue. The second hearing is set
for September 16, 2014 in Fort Walton Beach at 9 a.m.
No one from the public came forward to speak.
Mr. Boyles commented this is a matter of Okaloosa County getting
out of your backyard and the State of Florida coming in.
PUBLIC HEARING - REQUEST FROM DAVID AND JANET PRICE TO VACATE
PORTION OF GIBSON ROAD IN BAKER
Mr. Stanford read the advertised legal notice for public hearing
to consider the request of David and Janet Price to vacate a
portion of Gibson Road in Baker.
Mr. Jason Autrey, County Engineer, stated the request is to
vacate the southerly % mile of the road. Since submission of
the agenda item, objections have been received from citizens.
He advised if the Board does approve the vacation request, it
will be necessary to retain a utility easement.
Mr. David Price, petitioner, stated he owns property on one side
of the road and Mr. Dale Gibson owns land on the other side. He
explained the problems he has experienced with people racing up
and down the road, cutting donuts in his fields, tossing out
beer cans, and dumping dead animals.
Mr. Bob Walker, Sherman Kennedy Road, submitted a petition
signed by 118 peoples opposed to the road vacation. He said
Gibson Road is a postal route, school bus route, and trash
pickup route. He also stated that he has a note from the
postmaster objecting to the road closure. Mr. Walker commented
that kids drive crazy everywhere and he believes it is a bad
policy to close roads for that reason. He stated that he

contacted the Sheriff's Office and did not find where Mr. Price
had registered any formal complaints since January 1. Mr.
Walker also commented the sign posted to notify the public of
the hearing was very difficult to read.
Upon inquiry by Mr. Harris, Mr. Autrey replied the department
will make changes to the notification signs.
Mr. Price returned to the podium and stated Mr. Walker has a
personal grudge against him. He said he “caught him (Mr.
Walker) in my pond fishing,” as well as hunting on his property.
Mrs. Phyllis Enzor, 1436 The Crossings in Niceville, stated she
owns property in this area, noting she has spoken with Mr. Price
and has no objection to the requested closing of the road.
Mr. Walker asked to speak again and reported the incident Mr.
Price referred to about duck hunting on his property happened 15
years ago. He said he was under the assumption the man he was
hunting with had permission from the property owner but said he
learned that man was a “bit shady.” Mr. Walker stated he has
obtained permission from Mrs. Price to fish in the pond.
Mr. Dale Gibson stated when the road is wet, people come from
all over to go mudding on the road and have wound up in his
yard. He said people come down the road hauling debris to the
landfill without covering the loads and trash is blown all along
the road. Mr. Gibson pointed out there are only a couple of
people living on this portion of the road.
Mr. Harris referred to the petition with 118 names and asked Mr.
Walker the reason for the objection. Mr. Walker replied the
road has been there for 70 years and he likes to ride his bike
and run on the road. He commented that it does not make sense
to close the road.
Mrs. Janet Price, petitioner, remarked that she has nothing
against Mr. Walker but the problems her family experiences does
not pertain to his life. She said there are many other roads
for Mr. Walker to jog on. Mrs. Price stated she has a disabled
child and cannot even let him go to check the mail. She pointed
out she has lived on this road for 32 years and the kids are
tearing up the fields and because they are farmers, that is
their livelihood.

Mrs. Price stated the road is used as cut-through. She said
they have to pick up dead dogs and beer bottles before they can
plant. Mrs. Price stated there have been thefts at Mr. Gibson's
property and at the Naumans’ home, saying Mr. Gibson has filed
complaints with the Sheriff’s Office.
Mrs. Karen Nauman, 6099 Gibson Road, reported the last three or
four years have been worse than ever. She said there are cars
running up and down the road during the night without their
lights on and run their trucks through the fields. Mrs. Nauman
stated they have
