PUBLIC HEARING - REQUEST BY T-A-R, LLC TO AMEND FLUM DESIGNATION FOR 211.05 ACRES ON POINT CENTER ROAD Mr. Elliot Kampert, Growth Management Director, reported this public hearing was not advertised. He confirmed the request is to amend the Future Land Use Map (FLUM) designation only by changing from Rural Residential (RR) to Low Density Residential (LDR) . PUBLIC HEARING - ORDINANCE AMENDING CHAPTER 2 OF LAND DEVELOPMENT CODE RELATING TO ACCESSORY USES AND STRUCTURES Mr. Stanford read the advertised legal notice for public hearing to amend Ordinance No. 91-01, the Land Development Code, as submitted by the Growth Management Department to revise Chapter 2, Section 2.21.00 “Accessory Uses and Structures,” Subsection 10 “Livestock; Poultry; Beekeeping.” Mr. Kampert termed this a housekeeping item, stating the Legislature amended Section 586.10, Florida Statutes, to read: The authority to regulate, inspect, and permit managed honeybee colonies and to adopt rules on the placement and location of registered inspected managed honeybee colonies is preempted to the state through the depart- ment and supercedes any related ordinance adopted by a county, municipality, or political subdivision. September 2, 2014 ~9- Minute Book 71, Page 242 Okaloosa County Board of County Commissioners Further, from Section 586.045, Florida Statutes: Fach beekeeper having honeybee colonies with the state shall apply to the department, on forms supplied by the department, for certificates of inspection and registration, and for annual re- newal on the anniversary date of the registration. An application fee for renewal postmarked after the anniversary date shall be accompanied by a $10 late filing fee. Mr. Kampert clarified these regulations mean the Department of Agriculture will control beekeeping. He advised this is the first of two hearings on the issue. The second hearing is set for September 16, 2014 in Fort Walton Beach at 9 a.m. No one from the public came forward to speak. Mr. Boyles commented this is a matter of Okaloosa County getting out of your backyard and the State of Florida coming in. PUBLIC HEARING - REQUEST FROM DAVID AND JANET PRICE TO VACATE PORTION OF GIBSON ROAD IN BAKER Mr. Stanford read the advertised legal notice for public hearing to consider the request of David and Janet Price to vacate a portion of Gibson Road in Baker. Mr. Jason Autrey, County Engineer, stated the request is to vacate the southerly % mile of the road. Since submission of the agenda item, objections have been received from citizens. He advised if the Board does approve the vacation request, it will be necessary to retain a utility easement. Mr. David Price, petitioner, stated he owns property on one side of the road and Mr. Dale Gibson owns land on the other side. He explained the problems he has experienced with people racing up and down the road, cutting donuts in his fields, tossing out beer cans, and dumping dead animals. Mr. Bob Walker, Sherman Kennedy Road, submitted a petition signed by 118 peoples opposed to the road vacation. He said Gibson Road is a postal route, school bus route, and trash pickup route. He also stated that he has a note from the postmaster objecting to the road closure. Mr. Walker commented that kids drive crazy everywhere and he believes it is a bad policy to close roads for that reason. He stated that he September 2, 2014 -10- Minute Book 71, Page 243 Okaloosa County Board of County Commissioners contacted the Sheriff's Office and did not find where Mr. Price had registered any formal complaints since January 1. Mr. Walker also commented the sign posted to notify the public of the hearing was very difficult to read. Upon inquiry by Mr. Harris, Mr. Autrey replied the department will make changes to the notification signs. Mr. Price returned to the podium and stated Mr. Walker has a personal grudge against him. He said he “caught him (Mr. Walker) in my pond fishing,” as well as hunting on his property. Mrs. Phyllis Enzor, 1436 The Crossings in Niceville, stated she owns property in this area, noting she has spoken with Mr. Price and has no objection to the requested closing of the road. Mr. Walker asked to speak again and reported the incident Mr. Price referred to about duck hunting on his property happened 15 years ago. He said he was under the assumption the man he was hunting with had permission from the property owner but said he learned that man was a “bit shady.” Mr. Walker stated he has obtained permission from Mrs. Price to fish in the pond. Mr. Dale Gibson stated when the road is wet, people come from all over to go mudding on the road and have wound up in his yard. He said people come down the road hauling debris to the landfill without covering the loads and trash is blown all along the road. Mr. Gibson pointed out there are only a couple of people living on this portion of the road. Mr. Harris referred to the petition with 118 names and asked Mr. Walker the reason for the objection. Mr. Walker replied the road has been there for 70 years and he likes to ride his bike and run on the road. He commented that it does not make sense to close the road. Mrs. Janet Price, petitioner, remarked that she has nothing against Mr. Walker but the problems her family experiences does not pertain to his life. She said there are many other roads for Mr. Walker to jog on. Mrs. Price stated she has a disabled child and cannot even let him go to check the mail. She pointed out she has lived on this road for 32 years and the kids are tearing up the fields and because they are farmers, that is their livelihood. September 2, 2014 -11- Minute Book 71, Page 244 Okaloosa County Board of County Commissioners Mrs. Price stated the road is used as cut-through. She said they have to pick up dead dogs and beer bottles before they can plant. Mrs. Price stated there have been thefts at Mr. Gibson's property and at the Naumans’ home, saying Mr. Gibson has filed complaints with the Sheriff’s Office. Mrs. Karen Nauman, 6099 Gibson Road, reported the last three or four years have been worse than ever. She said there are cars running up and down the road during the night without their lights on and run their trucks through the fields. Mrs. Nauman stated they have had their vehicles ransacked. She gave her support for vacation of the road and did not feel anyone who lived on the road would be inconvenienced. Mr. Boyles stated this is in his district and he has been to look at the road. He said everyone that will be impacted by vacating this portion of the road has consented. Mr. Boyles commented that if anyone who lives on or owns property on this portion of the road had objected to the request, it would have made a difference. He said it is an old farm road which at some point began to be graded by the county and it is not a necessary thoroughfare. Mr. Boyles made motion, seconded by Mr. Harris, to approve the vacation request as advertised. Mr. Amunds noted there was no opportunity to see the petition, nor verify the signatures, which was presented by Mr. Walker. He said there appears to be an enforcement issue and asked Mr. Autrey if there is anything else the county can do. Mr. Amunds also expressed concern this could open the flood gates for closure requests because of enforcement issues. Mr. Autrey said putting it simply, “I cannot out design stupid.” He continued, explaining the review process when requests are made for right-of-way vacations. Mr. Autrey stated they examine what purpose the road serves, noting there are parallel roads to Gibson Road and the difference in traveling them will be about one mile. He advised this is a use-and-maintenance road and reiterated that he cannot design something for people who misbehave. Mr. Autrey stated the department supports the road vacation request. He also noted that anyone can make a request to close a roadway but each request is assessed individually. Mr. Autrey added they do not get into the emotional issues but look at the impact on traffic. September 2, 2014 -1l2- Minute Book 71, Page 245 Okaloosa County Board of County Commissioners The vote was taken on the motion to approve the vacation request-4 yeas. Mr, Harris made motion, geconded by Mr. Boyles, te approve this change order. Mr. Boyles asked for clarification, saying although it is styled as a change order the $4 Million is not over and above the projected costs. Mr. Turner replied “That is correct,” adding Lord & Son will scon present the Guaranteed Maximum Price (GMP) to the Board. Mr. Amunds said he understands the price is $21,300,900 for thas project. A budget of $150,000 was approved on February 4, 2014 to remodel the Sheriff’s Shalimar offices. He stated new work stations and other furniture was needed for the renovated space. Mr. Turner stated Sheriff Ashley has submitted receipts for expenses incurred for the renovation, estimating the total of those expenses at $150,000. Mr. Turner stated there are $123,058.48 remaining in Capital Outlay account 301-3160-562248 and requested those funds be transferred to the Sheriff’s budget to offset his expenses related to the renovation. Mr. Amunds said he understands there are problems with the soil samples taken at the site for construction of the Sheriff’s new building at the Shalimar compound which will add costs to the project. He asked how much in additional costs are anticipated, saying he does not want to borrow more money for this project. Mr. Turner reported a problem with the high water table. He said borrow dirt was taken from the Annex site and estimated the overage on the project at $100,000. Mr. Turner stated the Guaranteed Maximum Price (GMP) has not yet been presented for this project. Mr. Amunds stated we should not give money away until we find out where we are on this project and said he does not view that as a good business practice. Mr. Boyles made motion, seconded by Mr. Harris, to approve the recommendation to transfer $123,058.48 (remaining project renovation costs) to the Sheriff’s budget to offset costs associated with the renovation. 3 yeas, 1 nay. FACILITIES MAINTENANCE —- APPROVAL OF SITE SURVEY EXPENSE, CHOCTAW ENGINEERING Mr. Turner said last fall when projects were being discussed he came to the Board with a request to add the design of the Sheriff’s building to the Lord & Son design/build contract for the Shalimar Annex site. With the assumption this was acceptable, Lord & Son “ran full speed ahead” to get the work done and contracted with Choctaw Engineering to have the site survey work done. He stated it was later discovered this work did not fall under the existing Lord & Son contract. Mr. Turner reported there is no vehicle to pay for this work which Choctaw Engineering did in good faith, noting that survey work is being used for the project. He requested Board approval to pay September 2, 2014 -14- Minute Book 71, Page 247 Okaloosa County Board of County Commissioners Choctaw Engineering the survey costs of $1,356.
