Subject: RE: FDOT Steele Road Bridge Replacement
Greg/Kerry –
#8 | We are ok with this. Actually, our R/W agent, Jeff Henderson and I, met with FDOT onsite a few months ago to go
over R/W for the project. I can’t recall what was decided exactly, but FDOT should be preparing official R/W maps for
the project and will be responsible for obtaining any needed R/W and/or easement for the project.
#10 | We talked about this in regards to the other intersection projects. The same language is included in that Off‐
System Maintenance Agreement. I believe this is standard for FDOT and possibly even required when federal monies
are involved per the CFR, etc.
It seems we should be ok to adopt and execute these then.
Thanks,
Eric Broome, P.E.

Subject: RE: FDOT Steele Road Bridge Replacement
The following are the two concerns I have regarding this Agreement and Resolution. Otherwise it looks
fine.
Clause No. 8 and the County Resolution supporting the project, require the County to permit FDOT on its
behalf to take any measures necessary to acquire property needed for the project – including takings
and eminent domain. This may be a moot issue if the only property involved in this Project is the
County’s property.
Clause No. 24 requires the County to be 100 % responsible for any cost overruns, supplemental
agreements, and or liquidated damages not eligible to be paid for by federal funds due to the Federal
Highway Administration determining that said costs are non‐participating costs. I’m assuming that this
will be a deal breaker clause for FDOT, I just wanted to make someone aware of the potential
liability/risk to the County.
Additionally, it may be beneficial to stick in a Third Party Beneficiary clause.
