Regular Meeting
The regular Tuesday meeting of the Okaloosa County Board of
County Commissioners was called to order at 6:00 p.m. at the
Okaloosa County Courthouse in Crestview. Members present were
Charles K. Windes, Jr., Chairman; Nathan Boyles, Vice Chairman;
Wayne Harris; Dave Parisot; and Don Amunds. Also present were
Gary J. Stanford, Finance Director, Clerk’s Office; Ernie
Padgett, County Administrator; and Greg Stewart, County
Attorney.
COUNTY ADMINISTRATOR‘ S UPDATE
Mr. Padgett reported that work continues on the tentative budget
with Board workshops beginning July 14. He was hopeful to
deliver the tentative budget to the commissioners no later than
Friday, July 11. He pointed out that July 1, 2014, is the
retirement date for long-time County Attorney John Dowd. Mr.
Padgett stated from here on out County Attorney services will be
provided by the Nabors, Giblin, and Nickerson firm with Greg
Stewart serving as the firm’s representative at the dais. He
said Mr. Stewart will provide an update on the Department of
Juvenile Justice (DJJ) issue during this segment.
Mr. Stewart stated in January of this year a claim was filed
with DJJ and the Chief Financial Officer for $3.1 Million which
the State has wrongfully held. He announced that he has
received a letter denying the claim and advised the next step is
to pursue civil action. Mr. Stewart noted the suit must be
filed in Circuit Court in Leon County because that is where DJJ
is located. He said he has talked with other counties and they
are taking the matter to their respective boards. Mr. Stewart
said he also spoke with them about cost sharing and indications
are the other counties will agree to that option. He stated he
will need authorization from the Board to file this law suit.
Mr. Harris made motion, seconded by Mr. Amunds, to authorize Mr.
Stewart to file the suit against the DJJ and, possibly, the
Chief Financial Officer. Upon inquiry, Mr. Stewart stated eight
counties have joined in the filing at this time with a potential
for more. 5 yeas.
Also in connection with DJJ matters, Mr. Stewart stated an
invoice has been received from DJJ for Okaloosa County’s
contribution for secure detention for juveniles for FY 2014-15,
due in July. He recommended the Clerk’s Office be asked to hold

payment of that invoice until the Board can have an Executive
Session at the next meeting. Mr. Boyles made motion, seconded
by Mr. Harris, to call an Executive Session at the next meeting
(July 15) and to request the Clerk hold payment of the DJJ
invoice until direction is given after the Executive Session.
5 yeas.
COMMISSIONER’S MINUTE
Mr. Parisot and Mr. Boyles had no comments.
Mr. Harris wished everyone a safe and happy Fourth of July.
Mr. Amunds stated he has had a number of conversations with
Health Department Director Doctor Chapman and representatives of
the Choctawhatchee Basin Alliance regarding water quality
issues. He asked the Commission for discussion on _ the
possibility of forming a committee to look at water quality
while the county and cities are looking at stormwater issues.
Mr. Amunds described the potential committee as a = non-
governmental group which could address possible short-term
solutions with no expenditure of funds.
Mr. Harris said he believes the appointment of an advisory
committee would indeed be governmental in nature and subject to
Sunshine Law regulations. Mr. Amunds replied it would he
unofficial and meetings would be organized either by the
Choctawhatchee Basin Alliance or a Chamber of Commerce, Mr.
Stewart recommended exercising caution because once organized
“the line is close” with regard to Sunshine Law requirements.
Mr. Windes stated because of the number of boaters at Crab
Island, water quality has become an issue for that location. He
asked the Board if they have any objections to directing staff
to look at an option of having floating bathrooms at Crab
Island. No one voiced objection to the Chairman's request.
PUBLIC COMMENTS RELATING TO THE CURRENT AGENDA
No one came forward to comment.

Simpson Trust for a .75-acre parcel adjacent to the Sheriff's
Headquarters (HQ) facility in Shalimar. He advised the subject
property is across the street from the Second Street facility.
Undersheriff Adams said they propose to purchase the property
with federally seized drug money. He reported although the
property is currently zoned commercial, there are no problems
with the zoning. The intended use of the property is to replace
parking and equipment storage which was lost during’ the
expansion of the Second Street facility.
Undersheriff Adams stated the Sheriff's Office obtained an
appraisal on the property which came in at $165,000. The
landowner’s appraisal was $200,000 and the Property Appraiser's
assessed value is $245,000. He said the negotiated contract
price is $200,000.
Upon inquiry by Mr. Amunds, Undersheriff Adams stated the
strike-throughs on the supporting agenda document were made
during the back-and-forth negotiations. Mr. Parisot voiced
concerns about standing water on the property. Undersheriff
Adams responded there is a great deal of standing water at HQ
and in Shalimar when it rains. Upon further inquiry by Mr.
Amunds, Mr. Stewart answered this requested purchase is in
compliance with procedures.
Mr. Boyles made motion, seconded by Mr. Harris, to approve the
Sheriff's Office request to purchase .75 acre from the David A.
Simpson Trust (parcel ID #06-2S-23-0000-0018-0080) for $200,000.
4 yeas, 1 nay (Mr. Parisot voted no).

15. Purchasing: Approval to purchase beach cleaning equipment
Mr. Parisot stated Purchasing Manager Zan Fedorak submitted
additional information about the beach cleaning equipment via
email this afternoon prior to the meeting and asked her to
comment.
Mrs. Fedorak said she not only provided the commissioners with
this information but submitted a copy to the Clerk as well. She
stated the Public Works Department did make a recommendation on
which equipment to purchase, pointing out it was not the lowest
quote but the department did provide justification. Mrs.
Fedorak added the recommendation was well documented and staff
had the opportunity to review three demonstrations. She advised
the total price for two rakes is $95,800. The quote off State
Contract for the purchase of a new tractor was $46,032.36 but
staff negotiated this down to $42,500. The second rake will be
pulled with an existing tractor.
Mr. Parisot made motion, seconded by Mr. Amunds, to purchase the
beach cleaning equipment as outlined in the agenda request.

PUBLIC WORKS - EXTENSION OF LETTER OF CREDIT FOR WILLOW CREEK
PLANTATION PHASE II
Mr. John Hofstad, Public Works Director, stated the developer of
Willow Creek Plantation has requested an extension of the
warranty period for Phase II and acceptance of the maintenance
bond (Summit Bank Letter of Credit No. 201101 Amendment). The
new maturity date of this letter of credit is July 20, 2015.
Mr. Hofstad reported there are deficiencies in the
infrastructure and the additional time is needed for _ the
developer to make the repairs. Mr. Harris made motion, seconded
by Mr. Amunds, to approve the extension of the warranty period
in order for the developer to make necessary repairs and to
accept the amended letter of credit. 5 yeas.
PUBLIC WORKS - AUTHORIZATION TO ADVERTISE FOR RFQ FOR P.J. ADAMS
PARKWAY PHASE I PROJECT; RECOMMENDED REVIEW COMMITTEE
Mr. Hofstad requested authorization to advertise for Requests
for Qualifications (RFQ) from qualified engineering firms to
perform the Phase I Widening Design (from S.R. 85 to I-10) and
Right-of-way Acquisition (from S.R. 85 to Ashley Drive)
assistance for the P.J. Adams Parkway Project. Estimated cost
of this project is $4.4 Million. Mr. Hofstad reported a grant
award of $2.2 Million has been received from the Florida
Department of Transportation and the $2.2 Million match has been
budgeted.
The recommended review committee is: Commissioner Nathan
Boyles, County Engineer Jason Autrey, Design Engineer Eric
Broome, Operations Manager Rob VandenBroeck, and Water & Sewer
Senior Right-of-way Agent Jeremy Williams.
Mr. Boyles made motion, seconded by Mr. Harris, to approve the
agenda request to advertise the RFQ and to approve the review
committee. 5 yeas.
PUBLIC WORKS - UPDATE ON REPAIRS OF ROADS DAMAGED BY APRIL STORM
EVENT
Mr. Hofstad provided each commissioner with copies of an email
from Public Works Operations Manager Robert Vandenbroeck
regarding the status of roads damaged in the April 29-30 storm
event. He acknowledged the patience of affected residents is
wearing thin because some of the roads have not yet been
repaired. Mr. Hofstad reported repair costs are estimated at $5
July 1, 2014 -7- Minute Book 71, Page 120
Okaloosa County Board of County Commissioners
Million, adding they do not have a $5 Million reserve and will
be relying on FEMA contributions. A list of the most seriously
damaged roads was provide: Oak Hill Road, Shoal River Drive,
Okaloosa Lane, Lenwood Jackson Road, Hidden Springs Road, Sexton
Drive and W. Dodson Road.
Mr. Harris said the frustration is understandable but the Public
Works staff is doing a great job. Mr. Amunds posed questions
about running out of clay at the pits and locating other
sources. Mr. Hofstad replied clay pits have been located but
the owners want to sell the clay to the county. He said to
purchase a suitable-sized tract could cost $750,000 to $1
Million.
Mr. Boyles stated he will meet with the residents in his
district to discuss the repairs. He announced that on July 17
he will have a meeting in these chambers to discuss storm-
related issues.
Upon inguiry by Mr. Parisot, Mr. Hofstad stated all these
projects have been submitted to FEMA but not all will qualify.
PUBLIC WORKS - PILOT PROGRAM FOR ALTERNATIVE PROCEDURES FOR
DEBRIS REMOVAL
Mr. Hofstad stated a voluntary pilot program for Alternative
Procedures for Debris Removal is being offered through FEMA. In
this program if debris is removed within 30 days following a
storm event, the participating entity will receive an 85%
reimbursement rather than 75%. He stated his office made a call
to learn more and did submit paperwork for participation in the
pilot program. Mr. Hofstad advised this will be coordinated
with Mr. Stanford and the Finance staff.
PUBLIC HEARING - LPA 03-14, LARGE SCALE AMENDMENT FOR
TRANSMITTAL TO STATE
Mr. Stanford read the advertised legal notice for public hearing
to consider a request submitted by T-A-R, LLC to change the use
of land for 211.05 acres located off Point Center Road in
Crestview. The request is to change the Future Land Use Map
(FLUM) designation from Rural Residential (RR) to Low Density
Residential (LDR) or a more restrictive FLUM designation.
Mr. Elliot Kampert, Growth Management Director, reiterated this
is a large scale amendment to be transmitted to the state agency
July 1, 2014 -8- Minute Book 71, Page 121
Okaloosa County Board of County Commissioners
for review. He quickly reviewed the staff findings, advising
this is a Type 1 plan amendment because it involves ten acres or
more. The current allowable density under RR would allow up to
388 single-family dwellings. The proposed LDR designation would
allow up to 777 single-family dwelling units on the site. He
pointed out there are no other properties designated as LDR on
the FLUM proximate to the amendment site but the proposed
density is consistent with the character of development
established by the outward growth of the City of Crestview. Mr.
Kampert pointed out the site is within the Eglin North
Encroachment Zone and will require review and comment by the
county’s military representative. Finally, he stated the
applicant provided a letter, dated January 23, 2014, from a
local realtor indicating a need for building lots in the .25 to
.35-acre lot size south of I-10.
Mr. Kampert said the Planning Commission voted unanimously to
recommend approval at a public hearing on June 12, 2014 and
noted the military representative made no comment. Staff has no
objection to the proposed amendment provided the traffic
concurrency and access issues are addressed during development.
Mr. Tom Young, applicant, said he believes the county would
benefit from this change in land use.
Mr. Parisot stated the agenda request says the military
representative had no comment and asked for more details. Mr.
Kampert answered the military representative received a packet
and he did not provide any comment. Mr. Parisot confirmed the
military representative did have an opportunity to make comment
but did not.
Upon inquiry by Mr. Harris, Mr. Young stated D.R. Horton has
looked at the property and expressed interest in building
houses.
Mr. Boyles made motion, seconded by Mr. Amunds, to transmit this
large scale amendment request to the proper state agency for
review. 5 yeas.
PUBLIC HEARING - REQUEST TO VACATE PORTION OF RAILROAD STREET IN
OAKDALE MINIATURE FARMS
Mr. Stanford read the advertised legal notice for public hearing
to consider the request of Richard Peterman, representing Gary
McMorrow, to vacate a portion of the unimproved right-of-way of

Railroad Street lying west of Lot 2 Block 9 in Oakdale Miniature
Farms.
Mr. John Hofstad, Public Works Director, stated a request was
received from Mr. Peterman to vacate the advertised portion of
right-of-way, measuring 44.29 feet wide on the south end and
49.35 feet wide on the north end and having a north-to-south
distance of 216 feet. He said he also received a letter
requesting the stipulations be lifted, advising staff recommends
the stipulation for a utility easement remain.
No one came forward to speak in favor of or in opposition to
this request. Mr. Harris made motion, seconded by Mr. Amunds,
to approve the right-of-way vacation, retaining a utility
easement in the westerly ten feet of the vacated right-of-way to
protect any utility company infrastructure in place. 5 yeas.
RESOLUTION NO. 14-109
GROWTH MANAGEMENT - REQUEST TO SET PUBLIC HEARING TO DISCUSS
DISCONTINUANCE OF FIXED ROUTE TRANSIT SERVICE
Mr. Elliot Kampert, Growth Management Director, reported staff
anticipates a $328,000 deficit and staff recommends advertising
for public hearing on July 15 to discuss discontinuance of
Transit Routes 1, 2, 3, 4, 5, 14, 20, 30, 32, and 33. He stated
the cities have not made a commitment to participate in funding
these transit routes. Mr. Parisot made motion, seconded by Mr.
Amunds, to authorize advertising for the subject public hearing.
5 yeas.
WATER & SEWER - CLARIFICATION ON COLLECTION OF SYLVANIA HEIGHTS
MSBU ASSESSMENTS ON WATER BILLS
Mr. Jeff Littrell, Water & Sewer System Director, stated at the
last meeting during the public hearing to increase the Sylvania
Heights MSBU assessment to correct a_e shortfall, there was
considerable discussion regarding collection of the MSBU
assessment. He stated that of the 59 properties within this
MSBU boundaries which are not paying the MSBU assessment, 40 of
the accounts are inactive. Mr. Littrell explained that the
meters are being read but there is no usage. However, he said
five of those forty have active accounts with other utilities.
Mr. Littrell clarified there are no customers sending in partial
payments; he said they either pay the entire bill or they don’t
pay at all.

WATER & SEWER SYSTEM - EGLIN AFB UTILITIES PRIVATIZATION, UPDATE
AND AUTHORIZATION FOR STAFF TO NEGOTIATE
Mr. Windes asked Mr. Littrell if he is looking for authorization
to negotiate with this agenda item. Mr. Littrell replied in the
affirmative, saying they received 181 statements of government
concerns spread over 71 pages. He clarified that he is asking
for authorization to negotiate with the Defense Logistic Agency
(DLA) and return to the Board with a final proposal. Mr.
Parisot made motion, seconded by Mr. Boyles, to approve the
department head’s request. 5 yeas.
WATER & SEWER SYSTEM - APPROVAL OF AMENDMENT NO. 1 TO GRANT OF
EASEMENT WITH THE U.S. AIR FORCE FOR A UTILITY EASEMENT FOR THE
EAST COUNTY SEWER CONVEYANCE PROJECT
Mr. Littrell requested approval of Amendment No. 1 to the Grant
of Easement which provides an additional 100 feet by 100 feet of
property on which to build the repump station. Mr. Amunds made
motion, seconded by Mr. Parisot, to approve the amendment and to
authorize the Chairman to execute same. 5 yeas.
TOURIST DEVELOPMENT ~ AUTHORIZATION TO ENTER CONTRACT
NEGOTIATIONS WITH TOP RANKED FIRMS FOR DESIGN AND PRODUCTION OF
2014-15 VISITORS GUIDE
Mr. Ed Schroeder, Tourist Development Department (TDD) Director,
requested authorization to enter into negotiations with the top
three ranked firms responding to the RFQ for design and
production of the 2014-15 Visitors Guide (#1 Life’s A Beach
Publication; #2 Compass Media; #3 Avanti Group).
Mr. Boyles questioned negotiating with the Avanti Group when it
was ranked a distant third. Mr. Boyles made motion, seconded by
Mr. Parisot, to authorize negotiations with the top two firms.

TOURIST DEVELOPMENT - REQUEST TO TRANSFER FUNDS FOR PAYMENT OF
BEACH CLEANING EQUIPMENT
Mr. Schroeder stated he needs to move some funds--$150,000 to
$160,000--from reserves into an account to allow payment for the
additional beach cleaning equipment. He pointed out’ the
equipment will be purchased off state contract.
July 1, 2014 -11- Minute Book 71, Page 124
Okaloosa County Board of County Commissioners
Mr. Harris posed questions on the prior discussion on beach
cleaning equipment. Mrs. Fedorak stated the Public Works
Department will use the equipment and the TDC will provide the
funding for purchase of the equipment. She said originally the
discussion wag for Public Works to wurchase the rakes and
tractor and then have TDC reimbursement the department.
However, Public Works does mot have the Funds to make the
purchase and the discussion turned to TDC moving funds from its
YeServes account to make the purchase.
Mr. Amunds asked if there is amy urgency to take action at this
meeting, moting there are mo supporting documents to review.
Mr. Hofstad stated here is their thinking, if arrangements can
be made for the purchases, the demo unit is still here and could
be purchased. Further, the tractor to be bought is in Jay and
eould be delivered the next day. He said that means they could
return the rental equipment early, getting some credit and
saving money.
Mr. Pariset opined the simplest way to do this is by budget
transfer from the TDC to the aprropriate department in Public
Works. Mr. Heofstad agreed, saying there are no reserve funds in
the County Parks budget and it is not a qualifying expense for
the reserves in the Unincorporated County Parks MSTU fund. He
added they are not trying “to step on Finance.”
Mr. Amunds agked for Mr. Stanford’s input. Mr. Stanford replied
that he is not aware of the conversations which have taken
place. He stated the Clerk’s Office can prepare a budget
transfer document and place it on the next agenda.
Mr. Shewart noted that in terms of Isgality, beach cleaning and
beach cleaning equipment can be funded by tourist tax dollars.
Mr. Windes commented we cannot backuo mow and he belisves it is
the thing to do. Mr. Parisot said he believes the equipment
gtould be owned by the Public Works Department because in is
that staff which will be using and maintaining it.
Mr. Parisot made motion, seconded by Mr. Harris, to approve a
budget transfer from the TOC to the appropriate Public Works
accounk to pay for the beach cleaning equipment.
Mr, Boyles stated his comments have nothing to do with Mr.
Schroeder but the Tourist Development Department is still under
probation and he will not suppert this action without anything
July 1, 2014 -12- Mimute Book 71, Page 125

in writing. He reiterated there is nothing in today’s meeting
agenda packet on this item.
Mr. Padgett said the county employees have done a yeoman’s job
and he thinks they have explained this issue thoroughly. He
said he understands the importance on the one hand of being
cautious but also understands being flexible.
Mr. Amunds asked if this will come back on the next agenda if
approved tonight. Mr. Hofstad responded that the Board has
already authorized the purchase of the equipment and they are
asking to set up a capital equipment purchasing account. Mr.
Amunds asked for clarification if this request is only to open a
Capital equipment account. Mr. Boyles commented that is the
first time anyone has said anything about opening an account.
He stated he does not know what we are voting on. In response
to an earlier question, Mr. Hofstad stated the budget transfer
must come back to the Board.
Mr. Amunds again asked if this is for authorization to set up a
separate account. Mr. Stanford said perhaps he is confused. He
pointed out the Board has already approved the purchase of the
equipment on the Consent Agenda.
Mr. Parisot restated his motion: to set up a capital equipment
account and bring the budget transfer back at the next meeting.
Mr. Boyles questioned setting up an account with no money in it
and then returning at the next meeting to approve putting money
in it. He asked what he is missing.
Mr. Hofstad stated they need Board approval and they need an
account from which to make the purchases. Mr. Boyles stressed
this should have been placed on the agenda, noting a request was
made to purchase the equipment but no funding source identified.
Mr. Hofstad said he does not disagree but only realized during
the meeting they had no funding.
Again, Mr. Parisot stated his motion is to authorize setting up
a capital equipment account to purchase beach cleaning
equipment. 4 yeas, 1 nay (Mr. Boyles voted no).
AIRPORTS -~- AUTHORIZATION TO ISSUE RFQ FOR AVIATION CONSULTANT
FOR BAGGAGE HANDLING SYSTEM AND EXPLOSIVE DETECTION SYSTEMS AT

also requested approval of the recommended RFQ review committee:
Curtis Couch, TSA Site Manager; Kevin Metcalfe, TSA Checkpoint
Manager; Tracy Stage, Deputy Airports Director; Juanita Wright,
Airports Operations Supervisor; and Patrick Kennedy, Airports
Operations Coordinator. Mr. Boyles made motion, seconded by Mr.
Amunds, to approve the department head's requests. When Mr.
Parisot asked about a commissioner sitting on the review
committee, Mr. Harman said he would not recommend it because of
security issues. 5 yeas.
