STATEMENT OF ISSUE: WIM-FWB Invesors, LLC, the developer, is requesting the Board
of County Commissioners to release Performance Bond #20BSBGP5944 issued by Hartford Fire
Insurance, Co. in the amount of One Hundred Thousand Dollars ($100,000.00).
BACKGROUND: Plans for the TownePlace Suites Hotel project were approved on 3/12/13.
The plans included a proposed northbound right turn lane at the project entrance off Eglin
Parkway/SR 189. After the hotel project was completed, except for the proposed right turn lane,
a Temporary Certificate of Occupancy (TCO) was requested by the developer (in July 2014); the
right turn lane construction was delayed due to a major and unexpected conflict with a portion of
an existing sewer force main that had to be relocated. In order for the developer to obtain the
TCO and guarantee the construction of the right turn lane, a performance bond was submitted to
and accepted by the County.
The sewer force main was relocated; however, the proposed right turn lane has not been
constructed. A revised site plan (without the northbound right turn lane) and a traffic impact
analysis indicating that the proposed northbound right turn lane is not warranted were submitted
by the developer and approved by Public Works Department on 7/6/15. On 8/21/15, the project's
Certificate of Occupancy was approved by the Growth Management Department. Release of the
Performance Bond will formally close the project inspection process with Public Works.
OPTIONS: Approve/Disapprove the developer's request.
RECOMMENDATIONS: Release Performance Bond #20BSBGP5944 in the amount One
Hundred Thousand Dollars ($100,000.00).
