BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: December 15, 2015 TO: Honorable Chairman and Members of the Board FROM: Elliot Kampert SUBJECT: Bluewater Bay Curacao/Southwind Drainage HMGP Grant Agreement DEPARTMENT: Growth Management BCC DISTRICT: 5 STATEMENT OF ISSUE: Request authorization for Chairman to sign an Agreement with the Florida Division of Emergency Services to utilize Hazard Mitigation Grant funds. This item was tabled by the Board during its meeting of December 1, 2015. BACKGROUND: On December 16, 2014, the Board of County Commissioners authorized submittal of an application on behalf of the Bluewater Bay Municipal Services Benefit Unit to the Florida Division of Emergency Management to receive Hazard Mitigation Grant funds to undertake a study of the Curacao Way/Southwind Drive Drainage basin which is experiencing drainage problems, identify the necessary repairs, design and obtain permits for repairs and improvements, bid and retain qualified contractors to perform the required work, construct and complete the project. To ensure conformity with County requirements, the MSBU proposes to use County staff to assist with the preparation of bidding and construction documents; the value of staff time would be in-kind service and used as part of the local match required as discussed, below. The FDEM has approved the project and provided the attached agreement which breaks the project into two phases. Phase I consists of the study as well as the design and permitting of the improvements needed to alleviate the flooding problems. Phase II will be the actual construction of the drainage improvements. . As provided in the Agreement, the cost for Phase I is $130,240 for which the Federal share is $97,680 (75%). The local match requirement is $32,560 (25%). The estimated cost for Phase II is $269,225, again with a 25% match requirement ($67,306.25). To provide the match for Phase I, the MSBU proposes to provide $22,560, with the County (primarily Public Works) providing the remaining $10,000 through in-kind services. The exact amount of Phase II and the required match will be determined based on the results of Phase I. OPTIONS: The Board may authorize the chairman to sign the Agreement and subsequent documents or may choose to not do so. RECOMMENDATIONS: Staff recommends that the Board of County Commissioners authorize the Chairman to sign the attached Agreement as well as any other subsequent documents associated with this grant for the term of the grant. Staff also recommends that, prior to the encumbrance of staff time for in-kind services, the County and Bluewater Bay MSBU enter into a written agreement which specifies the duties and responsibilities of the MSBU and County in the administration of the grant and execution of the project. RECOMMENDED BY: APPROVED BY: John Hofstad, County Administrator
