BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: January 19, 2016 TO: Honorable Chairman and Members of the Board FROM: Jeff Littrell SUBJECT: Eglin Wastewater Treatment Contract Modification for Delivery Dates DEPARTMENT: Water and Sewer BCC DISTRICT: 3 STATEMENT OF ISSUE: Okaloosa County Water & Sewer (OCWS) staff is requesting approval from the Board of County Commissioners (BCC) to authorize the Chairman to execute the seventh contract modification with Eglin Air Force Base for delivery date extensions related to construction work and Capacity Expansion Charges (CECs) for Eglin AFB's wastewater at Camp Rudder. Attached for your review is both the modification itself and the completed County Contract Review Coordination Sheet. BACKGROUND: In September 2011, Okaloosa County went under contract (FA2823-11-C- 0030; County Contract No. C11-1906-WS) with the U.S. Air Force for the construction of the Duke Field wastewater infrastructure. The contract was modified in August 2012 to add the following: CECs for Duke Field, construction costs for Main Base wastewater infrastructure, CECs for Main Base, construction costs for Camp Rudder wastewater infrastructure, and CECs for Camp Rudder. The total contract amount is now $16,699,568; of that, $8,026,192 is reimbursement of design and construction costs, and $8,673,376 is for CECs. Since then, other contract modifications have occurred: - Contract Mod 3 - executed in April 2013 for flow charges (AKA monthly billing rates) related to transmitting, treating, and disposing of Eglin AFB's wastewater at Duke Field, Main Base, and Camp Rudder. This contract modification had no effect on financial terms. - Contract Mod 4 - executed in June 2013 to correct several administrative oversights pertaining to miscalculated delivery dates, payment methods, and verbiage of Eglin's internal processes. This contract modification had no effect on financial terms. - Contract Mod 5 - executed in December 2013 to extend the delivery dates for the construction work and CECs for Phase II (Eglin Main Connections) and Phase III (Camp Rudder Connections) by an additional 8 months due to government delays. The modification only extended delivery dates, and had no effect on financial terms. - Contract Mod 6 - executed in November 2014 to extend the delivery dates for the construction work and CECs for Phase III (Camp Rudder Connections) by an additional 6 months due to government delays. The modification only extended delivery dates, and had no effect on financial terms. Construction work has now been substantially completed on all phases of the contract - Duke Field, Eglin Main Base, and Camp Rudder. We are extremely proud of our staff, who have been working together with Eglin staff to successfully complete this large, complex project. Eglin AFB staff have requested the execution of a seventh contract modification to extend the delivery dates for the construction work and CECs for Phase III (Camp Rudder Connections) by an additional 6 months. This contract extension is necessary for the Federal Government's bureaucracy and allows for final invoicing to be completed. The modification only extends delivery dates, and has no effect on financial terms. For Federal Government accounting reasons, Eglin has given this amendment an effective date of 1/7/2016 and back-dated the Chairman's signature block to be 1/12/2016. OPTIONS: Approve or deny. RECOMMENDATIONS: OCWS staff recommends approval by the BCC to authorize the Chairman to execute the seventh contract modification to the Eglin Wastewater Treatment Re- configuration contract (#C11-1906-WS) for the delivery date extensions associated with construction work and CECs for Camp Rudder.
