AGENDA REQUEST
DATE: December 20, 2016
TO: Honorable Chairman and Members of the Board
FROM: Tracy Stage
SUBJECT: Change Order No. 3 for Destin Air Traffic Control Tower Project
DEPARTMENT: Airport
BCC DISTRICT: 5
STATEMENT OF ISSUE: The Airports Department requests the Board of County
Commissioners approve Change Order No. 3 with Environmental Management Resources of
Washington, Inc. (EMR, Inc.) to extend the construction time by 326 days on Contract No. C16-
2335-AP in order to complete the FAA equipment certification in the Destin Executive Airport
(DTS) Air Traffic Control Tower (ATCT) Project.
BACKGROUND: The construction contract for the ATCT Project at DTS was issued on
October 6, 2015 to EMR and the Notice-to-Proceed was issued on November 9, 2015. The
project includes the construction, equipping, roadway, and utilities of the DTS ATCT. Change
Order No. 1 was approved by the Board on October 4, 2016. Change Order No. 1 increased the
amount of time needed to complete the project by 47 days due to multiple months that exceeded
the normal amounts of rainfall giving the contract a scheduled substantial completion date of
October 24, 2016. Change Order No. 2 was approved by the Board on November 15, 2016.
Change Order No. 2 increased the amount of time needed to complete the project by 14 days due
to additional requirements discovered during construction giving the contract a new substantial
completion date of November 7, 2016.
The project is funded by Federal Aviation Administration (FAA), Florida Department of
Transportation (FDOT), Local Match (County), and approved Passenger Facility Charges (PFC).
See funding breakdown below.
FAA $2,000,000.00
FDOT $1,736,682.00
Local Match $597,356.00
Approved PFC $1,250.000.00
Total Funding $5,584,038.00
Additional supporting documentation to this Agenda Request:
Change Order No. 3 incorporates revisions to the contract documents for extension of the
contract date. The contract is required to be extended so that the Contractor’s Sub-
Contractor, Woolen, L.L.C., can complete work. Woolen is the sub-contractor providing
and installing all of the FAA equipment list and will not be able to complete the required
work until the FAA completes their work. At this time, the completion date for the
FAA’s work is unknown and as such, EMR’s contract is required to be extended. The
project is 99% complete with only the tower cab equipment lacking. We are at a
standstill until the FAA schedules their visit to test and accept the systems. Change
Order #3 has been approved by Airports Director, Tracy Stage, Project Engineer, Brad
Wente, and EMR, Inc.’s President, James Foster. Project Manager, Aaron Jackson
signed for Brad Wente in his absence. Mr. Wente confirmed his approval via email and
the email is attached as supporting documentation to this agenda request. The Change
Order was also approved by FDOT District 3 Program Manager, Philip Deal and FAA
Program Manager, Chastity Clark.
Change Order No. 3 will increase the amount of time needed to complete the project by
326 days. This Change Order will give the contract a new substantial completion date of
September 29, 2017.
Retainage attributable to completed services, work, or materials will be released upon the
submittal and approval of a future Contractor’s Pay Application. Retainage will be
withheld on any unfinished work and will be released upon completion of all work.
