RECITALS WHEREAS, on December 17, 2015, the County and Contractor entered into a Contract (C16-2357-TDD), which authorized the Contractor to provide Beach Parks Janitorial Services which is for a single year and two optional renewal years; and WHEREAS, the Contract in incorporated Exhibit “A” requires the Contractor to provide a Performance Bond; and WHEREAS, the County, as a result of certain unique circumstances related to this Contract and the services that are to be provided under it, has elected to not have the vendor provide the performance bond as required within the contract for the initial term and any renewal periods; and WHEREAS, the County reserves the right to include the requirement of a performance bond in subsequent contracts for these services. NOW THEREFORE, in consideration of the mutual covenants set forth herein and other good and valuable consideration, Contract C16-2357-TDD is amended as follows: 1. The requirement for the Performance Bond shall be struck from the contract in its entirety. 2. The County reserves the right to include the requirement of a performance bond in subsequent contracts for these services. 3. All other provisions of the Contract shall remain in full force and effect.
