BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: April 19, 2016 TO: Honorable Chairman and Members of the Board FROM: Elliot Kampert SUBJECT: Extension of Burleson Springs Master Plan Development Order DEPARTMENT: Growth Management BCC DISTRICT: 1 STATEMENT OF ISSUE: Board of County Commissioners to consider a 5-year extension of development order 290043-SDR-2005 "Burleson Springs Master Plan". BACKGROUND: In December of 2005, Southern Engineering on behalf of Mr. Grady Burleson submitted an application for a project to be known as Burleson Springs, a proposed 245 lot, single family subdivision to be constructed in five phases according to a conceptual master plan. The proposed project occupies approximately 141 acres and is located southeast of the intersection of Highway 85 North and Bradley Road in the unincorporated Crestview area. The Board of County Commissioners approved the Burleson Springs Master Plan on April 6, 2006 resulting in the issuance of development order 290043-SDR-2005 "Burleson Springs Master Plan" which was signed by the Growth Management Director on April 19, 2006. The Master Plan Development Order (MPDO) was approved for a period of ten years, expiring on April 6, 2016. The MPDO requires that each phase of the proposed development receive an individual development order. Consistent with this requirement, the applicant received development order 037581-PLT-2007 for Phase I, the 85-lot "Hidden Lake at Garden City", on November 3, 2008. Work has recently begun pursuant to the Phase I development order after a long dormant period caused by economic conditions. As work has taken place on the Phase I development site, the Phase I development order is not subject to expiration. The property owner has expressed his desire extend the Master Plan in order to continue to work under the approved Master Plan for future phases. As the Master Plan was approved by the Board of County Commissioners, the Master Plan Development Order must also be extended by the Board. Staff has reviewed the requested extension and has no objection to a five (5) year extension of Master Plan Development Order 290043-SDR-2005 during which time the applicant may apply for and receive development orders for phases 2 through 5. It should be noted that staff does not recommend that any further extensions beyond 5 years be granted if work has not commenced during the extension period. While the MPDO 290043-SDR-2005 was issued on April 19, 2006, its effective date was April 6, 2006; therefore, consistent with the chronology established by the 2006 Board the requested 5 year extension should take effect on April 6, 2016 and run through April 6, 2021. OPTIONS: The Board may approve or deny the requested extension. RECOMMENDATIONS: Staff recommends that the Board of County Commissioners approve the requested 5 year extension of Development Order 290043-SDR-2005, and authorize the Growth Management Director to issue a letter to the applicant, Grady Burleson, extending Development Order 290043-SDR-2005 for five years to begin on April 6, 2016 and ending April 6, 2021.
