BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: June 7, 2016 TO: Honorable Chairman and Members of the Board FROM: Elliot Kampert SUBJECT: Approve Agreement with Bluewater Bay MSBU for Drainage Project DEPARTMENT: Growth Management BCC DISTRICT: 5 STATEMENT OF ISSUE: Request execution of agreement between Okaloosa County and the Bluewater Bay Municipal Service Benefit Unit pertaining to the use of Hazard Mitigation Grant Program (HMGP) funds pursuant to HMGP Agreement 6HM-H4-01-56-01-300/Project 4177- 06-R. BACKGROUND: On December 15, 2015, the Board of County Commissioners authorized the Chairman to sign an Agreement (16HM-H4-01-56-01-300/Project 4177-06-R) with the Florida Division of Emergency Management (FDEM) in order to receive Hazard Mitigation Grant Program funds to be used for drainage improvements in the Curacao Way/Southwind Drive Drainage basin of Bluewater Bay which is experiencing drainage problems. The BCC authorization was contingent upon the County and MSBU entering into an agreement to identify the responsibilities of each in fulfilling the grant. Phase 1 of the overall project entails the engineering analysis and permitting, while Phase 2 entails construction of the physical improvements identified and permitted in Phase 1. The exact scope and cost of Phase 2 will be determined by the results of Phase 1, and will be incorporated into the Phase 2 grant agreement which will be developed by the FDEM and presented to the County. The attached agreement provides that the MSBU will adhere to all regulations pertaining to the use of the grant funds, including procurement and record-keeping, and also provides that the MSBU will contribute $22,560 of the required Phase 1 local match. The County will provide $10,000 of in-kind surveying and engineering services for its contribution. As of this writing, the MSBU has provided the County with $8,167 of the required local match, and has pledged an additional $3,400. The MSBU has also received a pledge from private donors for an additional $7,000. Added to the funds presented to the County ($8,167), the MSBU has committed as of this writing to $18,567 of the $22,560 which is its share of the local match. To ensure that the MSBU meets its obligation, staff recommends that the Board of county Commissioners approve the attached Agreement (which requires the MSBU to provide the full $22,560) with the condition that full amount be presented to the County no later than September 30, 2016, and that any shortfall will be withheld from the MSBU assessment proceeds on the November tax bill. OPTIONS: The Board may approve or reject the agreement. RECOMMENDATIONS: Staff recommends that the Board of County Commissioners authorize the Chairman to sign the attached agreement between Okaloosa County and the Bluewater Bay Municipal Services Benefit Unit with the stipulation that, if the full amount of the MSBU’s portion of the local match ($22,560) is not presented to the County by September 30, 2016, then any shortfall amount will be withheld from the MSBU assessment proceeds on the November tax bill.
