BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: June 7, 2016 TO: Honorable Chairman and Members of the Board FROM: Jason Autrey SUBJECT: Sovereignty Submerged Lands Lease Renew for Okaloosa Island Fishing Pier DEPARTMENT: Public Works BCC DISTRICT: 2 STATEMENT OF ISSUE: Renewal of Sovereignty Submerged Lands Lease for the Okaloosa Island Fishing Pier. BACKGROUND and ANALYSIS: Okaloosa County receives a Sovereignty Submerged Lands Lease from the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida for the Okaloosa Island Fishing Pier which is administered through the Florida Department of Environmental Protection. The term of the Lease is five (5) years and has a provision for unlimited renewals. Okaloosa County (Lessee) is authorized to operate a public fishing pier exclusively for passive recreation and fishing in conjunction with an upland bait shop and snack bar. This renewal will extend the lease to 2021. The Submerged Land Lease Renewal fee is $639.00 which covers the non-taxable instrument processing fee. An invoice for $3,457.35 has been received which includes the Land Lease Renewal Fee of $639.00 and the 2016/2017 Annual Lease Fee of $2,818.35. Due to issues within FDEP the renewal of this lease occurred after the expiration date of the prior lease; this delay was entirely due to an issue with FDEP and their process, not because of staff efforts. Staff has talked with FDEP regarding the timing and all assurances have been made that no errors or conflicts exist due to the time gap. The lease has been reviewed by the appropriate departments. OPTIONS: Approve/disapprove the renewal of the Sovereignty Submerged Lands Lease for Okaloosa Island Fishing Pier. RECOMMENDATIONS: Approve the renewal of the Sovereignty Submerged Lands Lease for the Okaloosa Island Fishing Pier and authorize the Chairman to execute the renewal documents. RECOMMENDED BY: APPROVED BY: John Hofstad, County Administrator
