STATEMENT OF ISSUE: Staff requests the Board of County Commissioners authorize the
Chairman execute a Release of Easements document between Okaloosa County Water & Sewer
(OCWS) and the developer of Partridge Hills Subdivision.
BACKGROUND: On 2/3/2015, the BCC approved the final plat for Partridge Hills
Subdivision, a 135-lot subdivision in unincorporated Crestview. Afterwards, as the Developer
(Mr. Tom Young) was in the process of selling platted lots to a builder, a title company
discovered two old easements given to OCWS. The first was a 20'-wide temporary construction
easement, and the second was a 15'-wide utilities easement. Both easements were provided by
Mr. Young to OCWS in August 2002. In March 2014, Mr. Young provided a new easement that
takes the place of the above-mentioned utilities easement, due to the current lot configuration of
his development. Now that the plat is approved and recorded, with dedicated right-of-ways and
easements to the County, the temporary construction easement is no longer needed. OCWS has
no further use of these two easements.
The easement that was obtained in March 2014 (attached as the "corrective easement") was at no
cost to Okaloosa County. In addition, Mr. Young paid for the water main in the previous
easement to be relocated, as part of his development. In coordinating with the County Attorney,
the attached Release of Easements document is the proper way to "abandon" these two
easements that are no longer needed. It is attached for your consideration, along with other
supporting documentation, such as the old easements and the County Contract Review
Coordination Sheet.
OPTIONS: Approve or deny.
RECOMMENDATIONS: Staff recommends BCC approval for the Chairman to execute the
Release of Easements document for the above-mentioned easements related to Partridge Hills
Subdivision.
