Regular Meeting
The regular Tuesday meeting of the Okaloosa County Board of
County Commissioners was called to order at 6:05 p.m. at the
Water & Sewer Administration Building in Fort Walton Beach.
Members present were Charles K, Windes, Jr., Chairman; Nathan
Boyles, Vice Chairman; Wayne Harris; Dave Parisot; and Don
Amunds. Also present were Gary J. Stanford, Finance Director,
Clerk's Office; Ernie Padgett, County Administrator; Greg
Stewart, Acting County Attorney; and representatives of the
media.
COUNTY ADMINISTRATOR'S UPDATE
Mr. Padgett reported that he spent a large portion of a day with
Gary Stanford, Finance Director, and Dave Skarzynski, Budget
Analyst, discussing budget preparations for Fiscal Year 2014-15.
He noted Property Appraiser Pete Smith has advised him there is
a slight uptick in property values and Mr. Smith will keep him
apprised of these figures.
With regard to the issue of overbilling by the Department of
Juvenile Justice (DJJ), Mr. Padgett stated he has spoken with a
number of County Administrators in other counties who have also
overpaid DJJ. He said their plans are similar to Okaloosa’s
which is to wait until the 60-day Legislative Session has ended
before making a decision on a course of action. Mr. Padgett
stated Sheriff Ashley has been instrumental in conveying figures
of overpayment directly to the Governor’s Office and thanked the
Sheriff for his assistance.
COMMISSIONER‘ S MINUTE
Mr. Parisot stated Elder Services wants to tear down the fire
wall at the old Fort Walton Beach hospital facility which was
recently constructed by county forces in order to move
equipment. He said Elder Services says they will rebuild the
wall. Mr. Parisot recommended Mr. Padgett offer use of a large
truck and personnel to move the equipment through the parking
lot rather than tear down this wall. Mr. Harris said he
believes it is within the purview of the County Administrator to
handle and that it is not a commissioner’s decision. Mr.
Padgett stated he and Facilities Maintenance Director Don Turner
will meet on site to review the situation, saying there is an
alternative.
April 15, 2014 -i- Minute Book 71, Page 16
Okaloosa County Board of County Commissioners
Mr. Boyles stated he will be attending the Florida Chamber of
Commerce Trade and Logistics presentation in Pensacola on
Thursday and will represent Okaloosa County in a panel
discussion.
Mr. Amunds stated last October a letter was sent to National
Seashore Park officials regarding a cooperative effort to
rebuild boat ramps. He said he was contacted today and they are
interested in working with staff on a possible Memorandum of
Understanding (MOU) on this item.
Mr. Harris advised that he had an opportunity to attend a forum
on Community Partnerships Initiatives with the military. He
said General Harris has taken on this program and will have
quarterly meetings. Mr. Harris noted the county and the
military are already working together but there are more
opportunities available.
Mr. Windes stated he would like to schedule a ceremony at the
next meeting in honor of long-standing County Attorney John
Dowd.

to Lots 1, 2, and 3 in Block 24 on the west side. The requested
area for vacation measures approximately 50 feet by 144.46 feet.
He pointed out the right-of-way has not been maintained and it
is overgrown. Mr. Hofstad reported staff has reviewed the
request and has no objections, adding no objections have been
received from the public.
Mr. Stephen Kennedy came forward. Mr. Stewart administered the
oath to Mr. Kennedy. Upon inquiry by Mr. Kennedy, Mr. Hofstad
stated this is a typical vacation, advising the vacated property
will be divided between adjoining property owners.

non-profit and not-for-profit organizations
Mr. Parisot stated the event permit requests listed as Items #21
and #22 on the agenda are non-profit organizations and if Item
#20 is approved he would like for the permit fees to Horizons
and Fort Walton Beach High School to be refunded. Mr. Harris
stated his concern is there are non-profits which make millions
of dollars per year and he would rather make a decision on a
case-by-case basis rather than with a broad stroke.
Mr. Parisot made motion to approve the waiver of park permit
fees for all non-profit and not-for-profit organizations and to
refund permit fees to Horizons and Fort Walton Beach High
School, Mr. Boyles stated he would prefer individual motions
because one of the items is a procedural matter.
Mr. Parisot made motion, seconded by Mr. Amunds, to approve the

TOURIST DEVELOPMENT - VISITORS GUIDE RFQ AND SELECTION OF REVIEW
COMMITTEE
Mr. Ed Schroeder, Tourist Development Department (TDD) Director,
stated in November 2013 staff directed Peter Mayer Advertising
to issue a RFP (Request for Proposals) for the Visitors Guide
April 15, 2014 -7- Minute Book 71, Page 22
Okaloosa County Board of County Commissioners
for the coming year. He said the process was not in line with
county policy and felt if the department went forward with the
three bids, it could be challenged. Mr. Schroeder stated the
process was negated and the Tourist Development Council (TDC)
approved bringing the matter to the Board for it to be conducted
properly. He requested authorization to issue a Request for
Qualifications (RFQ) for the Visitor Guide for 2014-15.
Upon inquiry by Mr. Parisot, Mr. Schroeder stated the selection
committee did not convene and review the RFPs.
Mr. Parisot made motion, seconded by Mr. Harris, to authorize
the Purchasing Department to issue the RFQ for the Visitors
Guide for 2014-15 and to appoint the following members to the
review committee: TDD Director, Research and Development
Manager, Marketing Manager, and a member of the TDC with a
member of the Purchasing Department acting as facilitator.
5 yeas,
TOURIST DEVELOPMENT - USE OF LAST MINUTE DEALS FUNDING
Mr. Schroeder stated the revised ad agency Strategic Marketing
Plan (approved March 18, 2014) included a category for Last
Minute Deals in the amount of $18,813. He said Task Order #136
with Peter Mayer Advertising is for advertisement placements,
specifically Visit Florida Meeting Magazine designed to target
meeting planners and for online keyword advertising designed to
target leisure travelers nationally. Mr. Schroeder advised
these items were approved by the TDC.
Mr. Boyles asked if this was approved after the fact. Mr.
Schroeder replied the department has concurrence from the TDC
Chairman to bring it to the BCC and then it will be returned to
the Tourist Development Council. Upon further inquiry by Mr.
Boyles, Mr. Schroeder acknowledged the money has already been
spent.
TOURIST DEVELOPMENT - NAMING OF OUTDOOR EXHIBITION AREA AT
EMERALD COAST CONVENTION CENTER
Mr. Shroeder said after an extensive process to select a name
for the 150-foot by 200-foot outdoor exhibition area constructed
on the north side of the Emerald Coast Convention Center (ECCC),
staff is recommending the Board approve naming the area “Bayview
Plaza.” Mr. Boyles asked for details of this extensive process.
Mr. Bill Leaman, ECCC Manager, stated staff began with 15

prospective names for the exhibition area. This list was
narrowed to ten names by staff and then the most popular name
with staff was recommended to the Board. Mr. Parisot made
motion, seconded by Mr. Harris, to approve naming the outdoor
exhibit area “Bayview Plaza.” 5 yeas.
WATER & SEWER SYSTEM - REPI PHASE 4 AGREEMENT WITH U.S. AIR
FORCE
Mr. Jeff Littrell, Water & Sewer System Director, requested
approval of the Readiness and Environmental Protection
Initiative (REPI) Phase 4 agreement with the U.S. Air Force.
This is a $200,000 grant to go toward land acquisition of a
Shoal River buffer which will benefit both the Air Force (Duke
Field flight path) and Okaloosa County (watershed protection for
future water supply). Mr. Littrell explained this grant will be
combined with three previous grants, bringing the total grant
monies to $1.1 Million. He said it will also consolidate all
four grants into one agreement.
Upon inquiry by Mr. Parisot, Mr, Littrell replied no land has
yet been purchased. He added that recently staff obtained
approval to get appraisals and to negotiate with property
owners.
Mr. Harris made motion, seconded by Mr. Boyles, to authorize the
Chairman to execute the Cooperative Agreement with the U.S. Air
Force and to authorize the Chairman to execute subsequent
related documents and any future modifications to this
Cooperative Agreement. Mr. Parisot remarked that he has a
problem with blanket authorizations. Mr. Harris said this
allows a cutback in bureaucracy and does not prevent the
department head from providing updates. 5 yeas.
WATER & SEWER SYSTEM - REQUEST TO ADVERTISE FOR PUBLIC HEARING
TO CONSIDER CONSTRUCTION OF EAST COUNTY FORCE MAIN AND REPUMP
STATION IMPROVEMENTS BY OCWS
Mr. Littrell requested authorization to advertise for a hearing
during a public meeting to consider a request by Okaloosa County
Water & Sewer (OCWS) to self-perform the construction related to
East County Force Main and Repump Station Improvements. Mr.
Boyles made motion, seconded by Mr. Amunds, to approve the
department head’s request. 5 yeas.

WATER & SEWER SYSTEM - EMERGENCY SOLE SOURCE PURCHASE OF
TRAILER-MOUNTED BYPASS PUMP
Mr. Littrell requested authorization for an emergency sole
source purchase of a 12-inch diesel powered trailer-mounted
bypass pump to be used at the Post Office Lift Station and other
lift stations in the future. In December 2012 the Board
approved a bid award for a large trailer-mounted bypass pump to
Thompson Pump of Pensacola as the low bidder meeting
specifications with a bid of $97,750. He advised this dealer is
willing to provide the same pump in the 2014 model for the same
price.
Mr. Littrell pointed out the Post Office Lift Station (located
on 37°" Street in Niceville) is one of the oldest in the service
area and has only one pump working. The second pump exploded on
March 27, 2014. Mr. Harris said the trailer-mounted unit would
be used in case the pump goes down. Mr. Windes stated this is
basically an insurance policy and the department believes it is
a time sensitive item. Mr. Littrell replied in the affirmative
to both commissioners’ remarks. Mr. Parisot made motion,
seconded by Mr. Harris, to approve this emergency sole source
purchase as recommended by the department head. 5 yeas.
WATER & SEWER SYSTEM - LAYNE CHRISTENSEN COMPANY CHANGE ORDER #3
FOR DEL CERRO II WELL
Mr. Littrell stated the proposed change order will add $99,530
to the scope of work. It will also add 153 days to the
substantial completion date and 122 days for final completion.
The Del Cerro II Public Supply Well in North County has been
delayed because of low yield and sand intrusion. To remedy the
high sand concentration and to improve water yield, a gravel
pack filter and screen is required. Mr. Harris made motion,
seconded by Mr. Boyles, to approve Change Order #3 with Layne
Christensen for the Del Cerro II Well project. 5 yeas.
WATER & SEWER SYSTEM - POLYENGINEERING TASK ORDER #115 REVISION
#2
Mr. Littrell stated Polyengineering is the consulting engineer
on the Del Cerro II Well Project. He requested approval of Task

Order #115 Revision #2 with Polyengineering which will add
$27,592 to the scope of work. Approval of this revision will
put the new total for Task Order #115 at $166,432. Mr. Harris
made motion, seconded by Mr. Boyles, to approve Task Order #115
Revision #2 with Polyengineering. 5 yeas.
WATER & SEWER - INSITUFORM TECHNOLOGIES CONTRACT RENEWAL AND
CHANGE ORDER #2
Mr. Littrell requested renewal of the contract with Insituform
Technologies (#C12-1955-WS) for two additional years, including
the adjustment of bid prices by appropriate CPI increases as
indicated in the contract. He also requested approval of Change
Order #2 to add scope of work for rehabilitation of gravity
sewer lines in the Garniers Service Area. Approval of Change
Order #2 will add $636,408.73 to the contract amount. Approval
of this change order will increase the contract sum _ to
$1,118,611.73. Mr. Boyles made motion, seconded by Mr. Parisot,
to approve the contract renewal and Change Order #2 with
Insituform Technologies. 5 yeas.
AIRPORTS - FOY SHAW INDUSTRIAL PARKWAY, BOB SIKES AIRPORT
Mr. Sunil Harman, Airports Director, stated in September 2013
the Board approved a cooperative agreement between the Airports
and Public Works Departments to advance the design and
construction of a new direct access connector roadway between
U.S. Highway 90 and Bob Sikes Airport (Foy Shaw Industrial
Parkway) . Based on evaluation of the roadway alignment
alternatives, as well as preferred environmental and cost
feasibility alternatives, the FDOT Joint Participation Agreement
was revised to include acquisition of right-of-way to fund the
purchase of 3.07 acres.
Mr. Harman requested action by the Board on the following items:
® Accept and approve the FDOT Supplemental Joint
Participation Agreement (SUPA) ; adopt the associated
authorizing resolution and authorize the Chairman to
execute same
e Approve the preferred environmentally and financially
feasible roadway alignment for the Foy Shaw Industrial
Parkway

by the Purchasing Department and managed by the Public
Works Department
e Approve the composition of a review committee, consisting
of Commissioner Harris, Public Works Director John Hofstad
or his designee, Tracy Stage (Airports), and Mike Stenson
(Airports)
Mr. Harman stated they are looking at two and a half years for
completion of the project; however, if everything goes according
to plan, it could be completed in twenty-four months.
Mr. Harris stated this will open significant manufacturing and
industrial opportunities for the entire region. Mr. Harris made
motion, seconded by Mr. Amunds, to approve these five items.
Mr. Stewart recommended each issue be considered by separate
vote.
Mr. Harris made motion, seconded by Mr. Amunds, to approve the
FDOT Supplemental Joint Participation Agreement for land
acquisition of Parcel B at Bob Sikes Airport and to adopt the
accompanying signature resolution. 5 yeas.
RESOLUTION NO. 14-82
Mr. Harris made motion, seconded by Mr. Amunds, to approve the
preferred environmentally and financially feasible roadway
alignment for the Foy Shaw Industrial Parkway as depicted in
Exhibit A of the agenda package. 5 yeas.
Mr. Harris made motion, seconded by Mr. Amunds, to approve the
purchase of 3.07 acres described as Parcel B of Parent Tract
identified as 14-3N-23-0000-0039-0010 from Mr. and Mrs. Richard
A. Howard at a cost of $58,000. 5 yeas.
Mr. Harris made motion, seconded by Mr. Amunds, to authorize the

PUBLIC WORKS - ACCEPTANCE OF OVERLOOK AT CHESTNUT RIDGE
SUBDIVISION INTO PERMANENT MAINTENANCE PROGRAM
Mr. John Hofstad, Public Works Director, reported Overlook at
Chestnut Ridge Subdivision has completed the 18-month warranty
period. He said the inspector has visited the site and
recommends acceptance of this subdivision into the county’s
permanent maintenance program. Mr. Harris made motion, seconded
by Mr. Boyles, to accept Overlook at Chestnut Ridge Subdivision
into permanent maintenance and to release the developer's letter
of credit. 5 yeas.
PUBLIC WORKS - VETERANS PARK WOODEN PEDESTRIAN BRIDGE AND
WALKING TRAIL
Mr. Hofstad requested Board approval for funding for
improvements to Veterans Park. He said the $150,000 lease fees
for the two front parcels on Okaloosa Island were to be used for
improvements and maintenance on the remaining 17 acres. A
decision was made to leave the park in a passive use state and
Phase I was subsequently approved. This phase consisted of a
walking trail through the east end of the park property. When
completed, the walking trail will tie into the pedestrian bridge
across Memorial Pond. However, the bridge has deteriorated and
is in need of repair.
One of the lessees, The Gulf Coast Marine Life Center, has
agreed to provide the labor for repairs to the bridge with
Okaloosa County supplying materials. The existing bridge is 8
feet wide and 170 feet long. The materials cost is estimated at
$61.73 per linear foot for a total materials cost of $10,500.
Continuing, Mr. Hofstad reported concerns have been voiced about
making the walking trail more accessible for handicapped
citizens. The trail is 6 feet wide, lined with 6” by 6” timbers
and filled with limerock base. He advised there is no way to
meet ADA construction standards for the walking trail because of
the topography, noting the land is considered a protected
Coastal Dune System. However, Mr. Hofstad said reasonable
accommodations can be made by decking the recently installed
walking path. This will cost $20,000.
April 15, 2014 -13- Minute Book 71, Page 28
Okaloosa County Board of County Commissioners
Upon inquiry by Mr. Amunds, Mr. Hofstad replied approval was
given to use the first year lease fees for the improvements.
The funding would be taken from this source if approved. Mr.
Amunds made motion, seconded by Mr. Parisot, to approve the
recommended improvements with funding ($10,500 for bridge
materials and $20,000 for decking the walking path) to be taken
from the first year’s lease fees for the two front parcels (Gulf
Coast Marine Life Center and Wild Willy’s). 5 yeas.
FACILITIES MAINTENANCE - FUNDING SOURCE FOR DAG ARCHITECTS
CONTRACT
Mr. Don Turner, Facilities Maintenance Director, stated at the
last meeting the Board approved entering into contract with DAG
Architects for the Sheriff's new building in Shalimar. He noted
that no funding source was identified for that contract.
In his agenda request, Mr. Turner recommended taking funding
Erom Account 301-3160-561100 which contains $400,000. He
reported he received communication from Budget Analyst Dave
Skarzynski that the $400,000 in this account is for the next
payment to the Meigs Trust for the Shalimar Annex property. As
an alternative, Mr. Turner proposed transferring $100,000
($80,000 for contract and $20,000 for incidentals) from 301-
3160-599300 which is Reserves for Future Capital Outlay. This
account contains $360,917.
Mr. Parisot made motion, seconded by Mr. Harris, to approve
funding for the DAG Architects contract in the amount of
$100,000 from the Future Capital Outlay Reserves account. Mr.
Boyles noted this is an amended recommendation from the one
listed on the agenda request. 5 yeas.
FACILITIES MAINTENANCE - SHALIMAR ANNEX ASBESTOS ABATEMENT
UPDATE
Mr. Turner advised that he has received a report from the
contractor regarding the asbestos abatement and the magnitude of
the work which must be done. He stated more than $170,000 will
be needed for this work. Mr. Turner noted we may soon run out
of ready reserves at this rate and the Board may need to
consider an interim or permanent funding source.
Mr. Amunds asked for Mr. Turner to provide the commissioners
with a status report on expenditures in the 3160 account. Mr.

Turner referred to the attachment to the previous agenda request
which is a printout of the Fund 301 Department 3160 account.
CORRECTIONS - STATE CRIMINAL ALIEN ASSISTANCE PROGRAM GRANT
APPLICATION
Mr. Paul Lawson, Chief Corrections Officer, requested approval
to submit a grant application to the U.S. Department of Justice

RESOLUTION NO. 14-83
PUBLIC COMMENTS
Mr. Taylor Ward, Sandman Beach Cleaning Service, read from a
prepared statement. (NOTE: A copy of the statement was not
provided to the Clerk’s Office for the record.) Mr. Ward's
remarks dealt with the events concerning the beach cleaning
contract, subsequent litigation, and the Board’s Executive
Session to discuss the litigation. He said following the
Executive Session the Board did not approve the settlement
agreement. Mr. Ward felt the Board could settle this issue and
believes the Board does have the authority to award him the
beach cleaning contract. He said he has complied with all the
county’s requests and asked the commissioners to let him know
when they are willing to do the same.
Mr. Windes expressed concern about Mr. Ward representing himself
in this matter before the Board, to which Mr. Ward replied that
his attorney is present in the audience. Mr. Windes asked if
Mr. Ward is willing to extend the emergency contract for 60 days
while this matter is sorted out. Mr. Ward questioned the
Board's two previous votes on the beach cleaning issue.
Mr. Windes asked the Board members if they want to entertain
this item any further. Mr. Parisot pointed out this item was
not on the agenda. Mr. Amunds asked for Mr. Stewart to comment.
Mr. Stewart replied that any citizen has the right to address
the Board and talk about issues which concern him. He
recommended the Board not get into a discussion in this forum
because of continuing litigation. Mr. Stewart pointed out the
emergency beach cleaning contract with Sandman expires on April
30, He said the Chairman's question to Mr. Ward was information
the Board needed to know and it will have to act accordingly.

Okaloosa County Board of County Commissioners
Mr. Ward stated there is no procedure in the county’s policy
manual which allows for such a request and suggested the Board
schedule another Executive Session. He said they could
participate in the session and discuss this together and then
come back to a public meeting. Mr. Ward said there is an
Opportunity to have another meeting before the emergency
contract expires. He advised the litigation was born out of
frustration and now he is being asked to do something he does
not understand.
Mr. Boyles stated he respects the current majority opinion of
the Board and stated his dissent. Mr. Harris added, “Here,
here.”
ADJOURNMENT
There being no further business to come before the Board, the
meeting was adjourned at 7:52 p.m.
