On October 23, 2006, the School Board approved the adoption of the BENCOR Plan,
and approved BENCOR as the administrator of the District’s 401 (a) Plan, Tax
Deferred 403 (b) Annuity plan, and 457 (b) Deferred Pay Plan. The documents
relating to the existing plan were executed on February 27, 2007, with master copies
of the documents available in the School Board Office. Effective January 1, 2009, the
Trustee for the BENCOR Plans is Wells Fargo Bank, N.A.
BENCOR has continued to update the plan according to changing federal tax laws and
has applied for and received intervening IRS approval letters. Most recently,
pursuant to IRS procedures, the BENCOR Plan was submitted to the Service for
review of cumulative statutory and regulatory changes. The Internal Revenue Service
has issued another favorable opinion letter, dated March 31, 2014, which supersedes
the prior advisory letters issued by the IRS on March 31, 2008 and June 2, 2009.
The Service determined that the BENCOR Plan continues to be qualified under
Section 401 (a) of the Internal Revenue Code. As an adopter of the BENCOR Plan, in
assuring the benefits of continued IRS approval of the School District plan, the
documents recently provided by the BENCOR National Governmental Employees
Retirement Plan must be executed and returned by April 30, 2016.
