STATEMENT OF ISSUE: Okaloosa County Water & Sewer (OCWS) staff requests the Board
of County Commissioners (BCC) approve and authorize the Chairman to execute a
Subordination of County Utility Interest between Okaloosa County and the Florida Department
of Transportation (FDOT).
BACKGROUND: In August 1977, Okaloosa County acquired a fifteen foot utility easement
from Mr. and Mrs. Sundy for the installation of County owned and maintained utility lines. In
May 2016, Okaloosa County was approached by FDOT about subordinating our utility interest in
this area. FDOT is in the process of performing road upgrades in this area and will require the
additional area for future right of way. Upon the subordination of the County utility interest, the
15-foot easement would then become FDOT right-of-way. No relocations are anticipated at this
time, and County utilities would remain in a public right-of-way. Although one (1) easement
was issued to the County in 1977, FDOT is requesting two (2) Subordination of County Utility
Interest documents because the easement is split between two (2) parcels.
Attached for your review is the original easement from Mr. and Mrs. Sundy, along with the two
(2) Subordination of County Utility Interest documents, respective Resolutions, and a FDOT
right-of-way map with the current utility easement depicted. The subordination documents have
been through County legal review, and a County Contract Review Coordination Sheet is
attached.
OPTIONS: Approve or deny.
RECOMMENDATIONS: Staff recommends BCC approval for the Chairman to execute the
two (2) Subordination of County Utility Interest documents and their associated Resolutions.
