BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: May 5, 2015 TO: Honorable Chairman and Members of the Board FROM: Elliot Kampert SUBJECT: Set Public Hearing to Amend Section 2.20.01 of the LDC to allow Open Containers in the RAC DEPARTMENT: Growth Management BCC DISTRICT: District 5 STATEMENT OF ISSUE: Set a public hearing to consider an ordinance amending Section 2.21.01 of the Land Development Code (Ordinance 91-01, as amended) to create an open alcoholic beverage container area within the Mid-Bay Regional Activity Center. BACKGROUND: Legendary/Destin Commons have requested that the Board of County Commissioners establish an area within the Mid-Bay Regional Activity Center in which alcoholic beverages may be consumed from open containers outside of licensed establishments. On May 6, 2014, the Board of County Commissioners authorized staff to work with the applicants to develop such an area. The applicants asked that staff place the issue temporarily on hold, but now have renewed the request. The Planning Commission will hear this matter during its regular meeting of May 14, 2015. The agenda summary for the June 16 hearing, if set by the BCC, will include the Planning Commission's recommendation and include a summary of the comments and public input received. OPTIONS: The Board may decide to set the hearing or not. RECOMMENDATIONS: Staff recommends that the Board set a public hearing to consider an ordinance creating an open container area within the Mid-Bay Regional Activity Center to be held during its regular meeting of June 16, 2015 at 9:00 AM or soon thereafter in the BCC chambers located on the third floor of the Okaloosa County Water and Sewer Building located at 1804 Lewis Turner Blvd in Ft Walton Beach.
