BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: August 18, 2015 TO: Honorable Chairman and Members of the Board FROM: James Puckett SUBJECT: Memorandum of Understanding for Utility Costs at the EOC DEPARTMENT: Facility Maintenance BCC DISTRICT: All STATEMENT OF ISSUE: Approval of a Memorandum of Understanding for Utility Payments in arrears for the Emergency Operations Center (EOC) in accordance with Lease Agreement dated August 5, 2008 and amended on October 21, 2010. BACKGROUND: Okaloosa County and Northwest Florida State College jointly funded the construction of the College's Community Services Complex at the Niceville campus. The college agreed to lease to the County a portion of the Community Services Complex for a new 911 Emergency Operations Center. In the Lease Addendum dated October 21, 2010, a requirement in the lease was the County to pay a proportionate share of electricity costs based on the designed load. A energy consumption review and estimate was prepared and was determined that the EOC's share of the electrical usage would be 78.4% of the total kWh/day. Due to an oversight, billing for the County's share of electrical costs was not received by the County. Staff together with a representative from the college worked on an agreement that granted approval that the county would be billed only for electrical costs from October 2014 going forward. OPTIONS: Approve/disapprove the Memorandum of Understanding for Utility Payments. RECOMMENDATIONS: Approve Memorandum of Understanding between Okaloosa County and Northwest Florida State College and authorize the Chairman to sign agreement.
