STATEMENT OF ISSUE: The Department of Airports requests that the Okaloosa Board of County Commissioners approve a Stipulation and Settlement of Claims for American Airlines. BACKGROUND: As it relates to American Airlines Bankruptcy matters, the salient facts are as follows: • American Airlines as part of its bankruptcy filing published schedule # 2040598 on 2/27/2012 for $32,730.88 in favor of Okaloosa Regional Airport as claimant. • Northwest Florida Regional Airport formerly known as Okaloosa Regional Airport filed claim # 2090 on 4/11/2012 for $32,314.31. • Invoices that comprise a schedule of payments covered the period and invoices save adjustment for partial payment on the post-petition portion of invoices show that the debt was cured. • However, a name change of the airport from Okaloosa Regional Airport to Northwest Florida Regional Airport during the ensuing period resulted in confusion and the claim being listed as a continued indebtedness. • Scheduled claim # 2040598 was not matched to claim # 2090 due to two different names being used for Northwest Florida Regional Airport. • Claim # 2090 was expunged on or around April 5, 2013 in connection with a lease cures payment paid to the airport which resolved the claim as verified by a payment schedule rum of the time-frame from the Clerk's office. • The stipulation and settlement of claims is necessary for the airline to have the court discharge the bankruptcy obligation. OPTIONS: Approve, Deny or Table the requested recommendation. RECOMMENDATIONS: The Department of Airports recommends that the Okaloosa Board of County Commissioners approve the Airline requested stipulation and settlement. As the pre- petition claim has been cured and the stipulation is necessary for the airline to seek discharge from the bankruptcy court. Furthermore, the airline is current and in good standing with the County. Further, pursuant to Contract C12-2006-AP, Romjue Advertising & Company (“Romjue”) is required to submit a Task Order for Media Buying, Marketing and Advertising Services. Attached is Task Order 15 from Romjue in an amount not to exceed $245,000 to market and promote the County's Airports. The referenced task order anticipates marketing and advertising needs for Fiscal Year 2015. BACKGROUND: On December 4, 2012 the Okaloosa County Board of Commissioners (“Board”) entered into an agreement with Romjue for the provision of media buying, marketing and advertising services in order to promote Okaloosa County's Airports. Following the suggestion from the Clerk’s Finance Department, we have prepared Task Order 15 which, if approved, would authorize Romjue, under the direction of airport staff, to perform services to purchase media as outlined in the attached Marketing Plan in an amount not to exceed $245,000. A summary description of the marketing plan is attached. BACKGROUND: The Lake Pippin Channel Maintenance Municipal Services Benefit Unit was created by Okaloosa County Ordinance No. 89-30. The special assessment is collected by the Okaloosa County Tax Collector on the yearly property tax bills. The annual assessment is applied to each parcel of property within the Lake Pippin Channel Maintenance MSBU. The Lake Pippin MSBU Committee met on June 26, 2014 and recommended the annual assessment for 2014 be increased from $400.00 to $425.00 per parcel. However upon further discussions with the Property Appraiser’s office, the Lake Pippin Channel MSBU Advisory Committee learned that if the assessment is raised above the five year average amount, a notice has to be advertised ‘in a newspaper generally circulated with each county contained in the boundaries…’, per Florida Statue 197.3632. Due to the inability to meet requirements of Florida Statue 197.3632, Michael Fell, the MSBU chairman, notified all Board members by email explaining the situation that the assessment could not be increased to the previously approved $425.00 assessment. Therefore Mr. Fell requested that all MSBU Board members and guest in attendance respond back to him whether they are in agreement or not that the 2014 assessment remain at the same 2013 assessment of $400.00. A majority of the MSBU Board members have responded with a yes vote. A resolution has been prepared for the Board of County Commissioners’ approval for the Lake Pippin Channel Maintenance MSBU 2014 assessment to remain at $400.00. The MSBU seeks Board approval of their proposed FY 2015 budget which is attached. OPTIONS: Approve or disapprove the annual Lake Pippin Channel Maintenance MSBU assessment of $400.00 per parcel of property and/or the MSBU’s FY 2015 proposed budget. RECOMMENDATIONS: Request Board approval and authorization for the Chairman to sign the Resolution for the annual 2014 Lake Pippin Channel Maintenance MSBU assessment of $400.00 per parcel and approve the MSBU’s FY 2015 proposed budget. I need your tax roll with any changes, that were originally due to our office by June 13th. The proof of publication that you submitted does not meet the requirements of Florida Statue 197.3632. This statue explains that if you raise the assessment above the five year average amount, then you will have to publish the advertisement “in a newspaper generally circulated with each county contained in the boundaries of the local government (197.3632 (4) (b)”. The statue goes on to state that the property owners have the right to file a written objection within 20 days of the publication of the notice, were the property owners given adequate time for this? It appears that at this time, you will only be able to raise the assessment the five year average amount which is the rate plus 1.743 for this year. Please return the tax roll information to me by July 11, 2014 with the allowable increase indicated per parcel (if that is what you choose to do since the advertisement wasn’t done pursuant to Florida Statutes)so we can get the new rates on the TRIM notices for this year.
