BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: September 16, 2014
TO: Honorable Chairman and Members of the Board
FROM: Elliot Kampert
SUBJECT: Change to Land Development Code - Beekeeping
DEPARTMENT: Growth Management
BCC DISTRICT: All
PUBLIC HEARING: Consideration of a request for changes to the Land Development Code
(LDC) submitted by the Department of Growth Management revising Chapter 2, Section 2.21.00
“Accessory Uses and Structures”, Subsection 10 “Livestock; Poultry; Beekeeping.” Second and
final adoption hearing.
STAFF FINDINGS: Chapter 2 “Zoning Regulations” was substantially re-written and the revisions
approved in May, 2010, including those regulations regarding livestock, poultry, and beekeeping. Since
that time the Legislature amended Section 586.10, Fla. Stat. to read, in pertinent part, as follows.
The authority to regulate, inspect, and permit managed honeybee colonies and to adopt rules on the
placement and location of registered inspected managed honeybee colonies is preempted to the state
through the department and supercedes any related ordinance adopted by a county, municipality, or
political subdivision thereof.
Section 586.045, Fla. Stat. further states as follows.
Each beekeeper having honeybee colonies within the state shall apply to the department, on forms
supplied by the department, for certificates of inspection and registration, and for annual renewal on the
anniversary date of the registration. An application for renewal postmarked after the anniversary date
shall be accompanied by a $10 late filing fee.
This means that the regulation of beekeeping is essentially reserved unto the Florida Department of
Agriculture which trumps county and city zoning regulations. The proposed change to Chapter 2 is
intended to promote consistency with state law and avoid potential misreading of the county’s zoning
regulations regarding beekeeping.
PUBLIC COMMENT/OPPOSITION: None to date.
STAFF POSITION: Staff supports the requested change to the Land Development Code.
RECOMMENDATION: It is recommended that the Board consider the facts presented herein, the
Planning Commission recommendation, as well as any other facts that may be presented at the public
hearing, and then decide whether or not to adopt the proposed change to Section 2.21.00, LDC by
ordinance.

BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: September 16, 2014
TO: Honorable Chairman and Members of the Board
FROM: John Hofstad
SUBJECT: Public Hearing - Okaloosa Island MSBU Additional Street Light
DEPARTMENT: Public Works
BCC DISTRICT:
STATEMENT OF ISSUE: Conduct a public hearing to receive input regarding the addition of
a street light on the west side of 910 Santa Rosa Blvd., Ft. Walton Beach, within the Okaloosa
Island Municipal Services Benefit Unit (MSBU).
BACKGROUND: A request for an additional street light to be added to the west side of 910
Santa Rosa Blvd. was made by Robert Beaudoin, a resident at 909 Santa Rosa Blvd., Ft. Walton
Beach. Previously the guard station for the Air Force resided near this location and provided
sufficient lighting. The lighting was removed when the Air Force relocated the guard station.
Mr. Beaudoin's request was investigated by the Okaloosa Island MSBU subcommittee. The
subcommittee presented their findings to the Okaloosa Island Leaseholders Association (OILA)
at a meeting held June 1, 2014. The proposed light was discussed and agreed upon. Due to
existing Gulf Power infrastructure at the requested site there are no installation fees. The
monthly fee of $6.20 will be absorbed by the MSBU and no additional assessment will be
required.
The request to conduct a public hearing on September 16 was approved by the Board on August
8, 2014. This public hearing was advertised in the Northwest Florida Daily Newspaper on
August 30 and September 2, 2014 and affidavits are attached.
OPTIONS: Approve/Disapprove the installation of a street light on the west side of 910 Santa
Rosa Blvd., Ft. Walton Beach, within the Okaloosa Island MSBU.
RECOMMENDATIONS: Request Board approval and authorization for the Chairman to sign
the contract with Gulf Power for the installation of an additional street light on the west side of
910 Santa Rosa Blvd., Ft. Walton Beach which is within the Okaloosa Island MSBU.

(This is a summary only - Attachment 5 contains the complete report)
The OILA MSBU Subcommittee would like to request that if anyone is requesting an additional streetlight
that they send the requests during the months of September or March. As there are fees and a good deal
of man hours involved in processing each of these. We believe that time and money could be saved in
consolidating rather than doing them one at a time all throughout the year. The legal notices alone cost
$167.18. New poles approx. $1,000. There is also a monthly fee for each new light.
Requests should include the exact location for which you are requesting, distance from the closest light
present, whether or not a pole is already in the location that a fixture could be added to.
Send requests to OILA MSBU Subcommittee, PO Box 4323, Fort Walton Beach, FL. 32549
These will be reviewed by OILA and forwarded to our Liaison with the BCC MSBU Board. Some areas
are dark now because trees have grown substantially and are blocking the illumination. Approximately
eight years ago we had an illumination study done by Gulf Power to determine where additional lights
were needed. At that time many new poles and lights were added as well as many lights were replaced.
REMEMBER-------IF YOU NOTICE A LIGHT
