READING DATE lst 2nd ORDINANCE 2007 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA, ANNEXING INTO THE CITY LIMITS OF FORT WALTON BEACH, FLORIDA A PARCEL OF LAND SITUATED IN THE UNINCORPORATED AREA OF OKALOOSA COUNTY, MORE PARTICULARLY DESCRIBED IN THE BODY OF THE ORDINANCE WITH A PHYSICAL ADDRESS OF 658 COUNTRY CLUB AVENUE NORTHEAST, FORT WALTON BEACH, FLORIDA; PROVIDING FOR MUNICIPAL BOUNDARY; AND PROVIDING FOR AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA AS FOLLOWS: SECTION 1. AUTHORITY AND INTENT The authority for enactment of this ordinance is contained in Chapter 166. 021( 1), and Section 171. 044 of the Florida Statutes, and Section 2 of the City Charter. SECTION 2. FINDINGS OF FACT The City Council of the City of Fort Walton Beach hereby finds the following: The for voluntary annexation from Mr. Christopher City received an application Goodpaster. The applicant has provided sufficient evidence of ownership of said property to be annexed. The subject property is contiguous to the municipal boundaries of the City of Fort Walton Beach, is an area that is reasonably compact, and is unincorporated territory. The annexation of subject properly will not result in the creation of any enclaves. The notice of annexation was duly published once a week for two ( 2) consecutive weeks in the Northwest Florida Daily News, a newspaper published within the City of Fort Walton Beach. Upon adoption, this ordinance will be filed with the Clerk of the Court of Okaloosa County, the Okaloosa Counry Administrator, and the Florida Deparhnent of State. SECTION 3. PROPERTY ANNEXED The following described property is hereby annexed into the City of Fort Walton Beach: LOT 5 BLOCK E OF THE COUNTRY CLUB ESTATES SUBDIVISION ACCORDING TO THE PLAT THEREOF AS RECORDED 1N PLAT BOOK 3 AT PAGE 41 OF THE PUBLIC RECORDS OF OKALOOSA COUNTY, FLORIDA. The total actual acreage of above described property is approximately 1/ 3 acre. At the time of the annexation there is one ( 1) single-family residential building on site. Parcel Number: 36- 15- 24- 0540- 000E- 0050  SECTION 4. EFFECT OF ANNEXATION The area annexed shall be subject to all laws, ordinances, and regulations in force in the City of Fort Walton Beach and shall be entitled to the same privileges and benefits as other parts of the City of Fort Walton Beach upon the effective date of the annexation. The area annexed is subject to the Okaloosa County Comprehensive Plan and zoning regulations. Said regulations shall remain in full force and effect until the subject property is designated into a City of Fort Walton Beach Comprehensive Plan Future Land Use Map designation and rezoned accordingly in the City of Fort Walton Beach zoning map. SECTION 5. MUNICIPAL BOUNDARY The municipal boundary lines of the City of Fort Walton Beach shall be amended to include the annexed property described in this ordinance and in the attached" Location Map." SECTION 6. EFFECTIVE DATE This ordinance shall take effect immediately upon adoption on second reading by City Council and the signature of the Mayor. Adopted: M, ar n l_. a_ Richard A.
