RESOLUTION NO. 83-30
A RESOLUTION AUTHORIZING LANDSCAPING AGREEMENT
BETWEEN THE CITY OF FORT WALTON BEACH AND FLORIDA
DEPARTMENT OF TRANSPORTATION ON A PORTION OF STATE
ROAD NO. 30.
WHEREAS, as a result of negotiations between parties, the
City of Fort Walton Beach and the Florida Department of Trans-
portation desire to enter into an agreement providing for
maintenance of landscaping on that portion of State Road No. 30
from Mile Post 9.148 to Mile Post 10.801, all of which is with-
in the corporate limits of the City, a copy of which agreement
is hereto attached entitled "Highway Landscaping Memorandum of
Agreement":
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WALTON BEACH That the City Council does hereby
approve said Highway Landscaping Memorandum of Agreement and
the Mayor and the City Clerk are hereby authorized to execute
same on behalf of the City.
This resolution shall take effect immediately upon its
approval by the Council and upon execution by the Mayor.

HIGHWAY LANDSCAPING
MEMORANDUM OF AGREEMENT
THIS AGREEMENT, made and entered into this
12 th day of July , 1983,
by and between the STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION, a component Agency of the State of
Florida, hereinafter called the "Department", ane
the CITY OF Ft. Walton Beach , & Municipal
corporation in Okaloosa “County, Florida,
existing under the laws af Florida, hereinafter called
the "City".
WITNESS ET R:
WHEREAS, as a part of the continual updating
of the State of Florida Highway System, the Department,
for the purpose of Safety, has created a median strip
dividing the traffic lanes on that part of __ State
Road 30 Section 57030
from Mile Post 9. 418-——— ~ ° £C
Mile Post 10.801 within
the corporate limits of the City; and
WHEREAS, the entire length of this above-mentioned
project is within the corporate limits of the City; and
WHEREAS, the parties hereto are of the opinion
that said median Strip shall be attractively landscaped
with various flora; and
WHEREAS, the City, by Resolution No.
dated 1983, attached hereto
and by this reference made a part hereof, desires to enter
into this Agreemenct ana authorizes its officers to do so.
NOW, THEREFORE, for and in consideration of the
mutual benefits to flow €ach to the other, the parties
covenant and agree as follows:
1. The City wiil install plantings within
the median stric on that part of State Road 30
Section 57030 from Mile Post 9.418
to Mile Post 10.801
according to the plans
and specifications attached hereto and made a part of
this Agreement. All such installations shall be made
under the supervision of and to the satisfaction of the
Department. . :
It is contemplated by the parties that the planting
installation program and other necessary incidental improve -
ments shall be accomplished within a four (4) year period
commencing with the Cities 1984 fiscal year.
