Resolution 99- 19 o o A RESOLUTION OF THE CITY OF FORT WALTON BEACH RELATING TO A PUBLIC IHPROVEMENT BY SPECIAL ASSESSMENT; DECLARING IMPROVEMENTS TO THE STREET, DRAINAGE AND SIDEWALKS ON BUTLER DRIVE IN THE CITY OF FORT WALTON BEACH; SETTING A TIME AND PLACE FOR A PUBLIC HEARING BEFORE CITY COUNCIL; SETTING TOTAL ESTIMATED COST OF THE IHPROVEMBHTS IN ACCORDANCE WITH APPROVED PLANS AND SPECIFICATIONS; LEVYING ASSESSMENTS FOR THE TOTAL COST OF SAID IHPROVEMBHTS; DESCRIBING THE LARDS UPON WHICH ASSESSMENT SHALL BE LEVIED; PROVIDING FOR THE PROPER PUBLICATION OF RESOLUTION AND NOTIFICATION OF PROPERTY OWHBRS AS REQUIRED; PROVIDING FOR AN EFFECTIVE DATE HEREOF. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA: SECTION That the City of Fort Walton Beach shall make street, drainage I: and improvements on Butler Drive in the City of Fort Walton Beach in sidewalk accordance with plans and specifications heretofore submitted to and approved by City Council and as may be amended during the progress of the work. SECTION II:City of Fort Walton Beach shall hold a Public Hearing That the in the Council City Hall, 107 Miracle strip Parkway, SW, at 7: 00 pm, Chambers at or as soon thereafter as the issue may be heard, Tuesday, September 21, 1999 at which the owners of the property to be assessed or any other persons interested therein may appear before said City Council and be heard as to the propriety and advisability of making such improvements on Butler Drive. SECTION III: That all lots and land specially benefited by these Butler Drive in the of Fort Walton Beach have a special improvements on City assessment levied against them. The total estimated cost of said project is 237, 500 and includes construction and engineering costs. SECTION IV: That the assessments shall be levied on a per front foot basis. All assessments are due and payable thirty ( 30) days after completion date improvements and a resolution accepting the same is of the adopted by City Council. Thirty days after completion and resolution adoption, interest will accrue at the rate of eight percent ( 8%) per annum on the unpaid balance. The assessment may be paid in five ( 5) annual installments. SECTION V: That lands upon which said special assessments shall be levied are described as: All lots and land adjoining and contiguous or bounding and abutting upon such improvements or specially benefited thereby and further designated by the assessment plat ( Exhibit " B") hereinafter provided for, said located at: 730 through 751 Butler Drive NW in the City of Fort property being Walton Beach, Florida. SECTION VI: That the City of Fort Walton Beach shall cause this resolution to published two be times, a week apart, in a newspaper of general circulation and the last publication shall be at least one week prior to the date of the each public hearing.
