City must update the entire Land Development Code to accommodate the revisions to the Comprehensive Plan, which includes revising the zoning districts' boundaries and descriptions. Given the scale of changes needed, the estimated completion time is early 2012. The applicant desires to open a business before the 2012 timeframe for completion, and thus requests a specific amendment to the Land Development Code at this time. 5. FINANCIAL INFORMATION: 5. 1. Ordinance No. 1846 has no direct financial impact to the City. 6. MUNICIPAL PLANNING BOARD RECOMMENDATION: 6. 1. The Municipal Planning Board ( MPB) unanimously recommended approval of Ordinance No. 1846 at their December 23 2010 regular meeting. 7. STAFF RECOMMENDATION: 7. 1. Based on the above analysis and the MPB recommendation, Staff recommends approval of the request to amend Table 15 -2 of the Land Development Code to allow " Auto Parts Sales with No Installation" in the Mixed Use Community Commerical -2 ( MUCC- 2) District. Amendment of Table 15 -2 27 Chapter 15, Zoning Districts, of Volume V, Land Development Code, is hereby 28 amended to permit, " Auto Parts Sales with No Installation" in the Mixed Use Community 29 Commercial -2 ( MUCC -2) District only, as listed in Table 15 -2. 30 31 Section 3. Conflicts 32 All ordinances or parts of ordinances in conflict with this ordinance are repealed 33 to the extent of such conflict. 34 35 Section 4. Severalbility 36 If any word, phrase, sentence, paragraph or provision of this ordinance or the 37 application thereof to any person or circumstance is held invalid or unconstitutional, 38 such finding shall not affect the other provisions or applications of this ordinance which 39 can be given effect without the invalid or unconstitutional provision or application, and to 40 this end the provisions of this ordinance are declared severable. 41 42 Section 5.
