WBEBEAS, in order to tacilitate such work it is necessary that provisions be made tor adJustment, change or relocation of certain faci11t.iea and/or utilities with1n said City and located within the right of way of s8,id municipal ,connecting link State Road or appurtenances thereto, viz: Any and all water mains, fire hydrants , sanitary 8ewers, gas mains, tire and police call systems, telephone, eIectri- cal and telegraph systems, lines and including poles, pole underground tac ili't:1es ' thereot , and8lly . other utilities and facilities within such right of way.  o NOW, TBEBEFOBE, the premises considered and in consideration 0'1 the sum ot One ($ 1. 00) Dollar moving between the parties and in tU%" ther consid- eration of the mutual covenants hereinafter contained, it is agreed by the parties as follows: l- That the Department viII provide at its expense tor the construc- t1on, reconstruction, change or replacement of all drainage structures necessary to properly drain said munioipal connecting link State Road within the' said City, ~ ut not otherwise. 2- That in consideration of the Department ' 8 undertaking the construe- tion or reconstruction 0'1 said municipal connecting link State Road which will be of benefit to the City and the citizens thereof as a City thoroughfare, the City agrees to make or cause to be made all necessary adjustments, re.. locations or changes ot said facilities or utilities thereoa, municipal or otherwise, in order to comply with the plans, designs and specifications 0'1 the Department for the construction or reconstruction of said m\micipa. l connecting link State Road, without cost or expense to the Department. The City further agrees that said adjustments, changes or relocations of said facilities or utilities will be performed by the City or at its direction with sufficient promptness so 8S to cause no delay to the Department or its contractor on such construction or reconstruction work on s8id munic ipal connecting link State Road. The City further agrees: That in the event this work is done simultaneously with the construction 0'1 the project the City agrees to reinburse the contractor directly for any '" ust claim due to delays caused by the City' s operations, or hinderance to the contrac'tor' s efficient prosecution of his work. The City further agrees to make and enter into written a agreement with the Department t s successful bidder and tile an executed copy with the Department to provide as tollows: 1. Covering procedure for coordinating the work. 2. Minimization ot de lays . i 3. Method of arriving at compensation to contractor tor delays occasioned by City' s olJ8rations.
