RESOLUTION NO. 15-189
PUBLIC HEARING - ESTABLISHING VESSEL EXCLUSION ZONE (CRAB
ISLAND)
Mr. Stewart stated following the direction of the Board, staff
met with various stakeholders, including the Corps of Engineers,
U.S. Coast Guard, Sheriff’s Office, and City of Destin regarding
a proposed ordinance to address the problem of emergency access
to the Crab Island area. The proposed ordinance will create a
Vessel Exclusion Zone 40 feet wide and % mile long through the
middle of Crab Island.
Mr. Stewart said under Florida law there are limited
restrictions that local governments can place on vessels.
Counties and municipalities may create vessel exemption zones
where there is an area requiring a particular activity and user
group to be separated from other activities to protect the
safety of those participating in such activity. He stated law
enforcement and emergency vehicles fall within that category.
Under the statutes, any restriction imposed by a local
government must be approved by the Florida Fish and Wildlife
Conservation Commission (FWC) prior to the effective date of the
ordinance.
Mr. Windes stated Representative Gaetz called a townhall meeting
a few months ago to discuss this issue. He said the meeting was
well attended and many options were explored. Mr. Windes stated
the majority opinion was an “over reach” of authority was not
necessary but something simple could be done for safety’s sake.
He added the draft ordinance has been well vetted.
Mr. Greg Kisela, Destin City Manager, said he echoes the
comments of Mr. Windes and Mr. Stewart. He agreed the proposed
ordinance has been vetted through all state and local agencies.
Mr. Kisela encouraged the Board to adopt the ordinance.

Mr. Stewart reiterated because of the restrictions on local
governments this ordinance cannot take effect immediately and
will be sent through the FWC process.
Mr. Windes made motion, seconded by Mrs. Ketchel, to approve the
Vessel Exclusion Zone Ordinance and to authorize staff to
prepare the application to the FWC as required by state law.

Board may want to take comments if there are any. Mr. Stewart
said the public hearing will be advertised for a future date.
Mr. Boyles opened the floor for public comments. There were

RISK MANAGEMENT - APPROVAL TO BIND COVERAGE FOR COUNTY INSURANCE
PROGRAM
Mrs. Kay Godwin, Deputy County Administrator, stated the
insurance renewals being brought forward at this time are for
the «county’s general 1liability, <c¢rime, automobile, excess
workers’ compensation, public officials, aviation liability, and
AD&D insurances. She stated Mr. Paul Dawson, Senior Vice
President of Public Risk Insurance, will detail some of the
proposed changes in coverage.
Mr. Dawson stated the company evaluated the policies for
most/best coverage. They propose a change in collision coverage
under the automobile policy by the county self-insuring vehicles
valued at less than $25,000 and maintaining a $10,000 deductible
for vehicles valued at $25,000 and above. This will result in a
3.67% premium reduction or cost savings of $22,850 in comparison
to the current policy which covers all vehicles valued at
$10,000 and greater. The only change in the above listed
insurances is the automobile coverage.
