Fort Walton Ordinance 50: Palmetto Avenue vacation — reading text

AN ORDINANCE # 50 ENTITLED AN ORDINANCE to discontinue, vacate and close the unopened and unused portion of a street known as Palmetto Avenue, the said portion lying Last of the Northeast line of Florida Avenue (State Highway No. 85) and West of the Southwest line of Ferry Aveniie as shown on map of Ocean City, a Subdivision of the Southeast quarter of Section 13, Township 2 South, Range 24 West in Okaloosa County, Florida. WHEREAS, prior to the time the same was included within the corporate Limits of the Town of Fort Walton, the Southeast quarter of Section 13, Township 2 Range 24 West in Okaloosa County, Florida, was subdivided iri accordance with a plat designated "Map of Ocean Cit," as amended January 15, 19383 and WHEREAS, the said Subdivision map shows a street known as Ferry Avenue and shows also a street known as Florida Avenue, the later heing the same as Htate Highway No. 85, and the seid map also shows a street knovn as Palmetto Avenue; and WHOREAS, that portion of Palmetto Avenue lying hast of the Northeast line c” Florida Avenue, or State Highway No. 85, and West of the Southwest ° Ferry Avenue, as shown on said map, has never heen opened up as a street or roadway and it is not necessary ov-.desirable to anv of the property shown in the said Subdivision plat that the same should he ovened or main-~ tained as a street or rublic-way but on the contrary it js desirahle that the same should he d’scontinued, vacated and closed: Tas. Thet that portion of Palmetto Avenue lvins Hast of the North- east Line of Florida Avenue, or State Highway No. 85, and West of the South- west line of Ferry Avenue, as shown on the ahove mentioned map of Ocean City, he and the seme is hereby di scontimied, vacated and closed and that the same shall no longer he considered opened or used as a street or public-way of any STTON 2, That the vroperty and land contained in the said portion of vd o Avenue so discontinued, vacated end closed shall revert to private whership of abutting property owners as nrovided hy the laws of Florida.
