Vest Cc: Cathy Demoreski Subject: Proposed Amendment to Boundary of Mid-Bay Regional Activity Center Good morning, The County has received a request from Tom Patton and Peter Bos to amend the boundary of the Mid-Bay Regional Activity Center (RAC) to include the Mid-Bay Marina as well as a small outlying parcels of vacant land they wish to develop as part of the Turnberry Harbor PUD. The proposed boundary amendment does not seek the approval of any additional development. What it does accomplish is bring the marina and the vacant land under the aegis of Chapter 28-24 of the Florida Administrative Code which increases the thresholds which would require proposed development to undergo development of regional impact review. Under the proposed boundary amendment, the existing marina DRI will remain as-is. After the County approved the original RAC in 2000, it entered into an agreement in 2002 with the developers to accomplish certain road improvements (that have been done) which gave them a “trip bank” (see paragraph G of the Agreement inserted below) to draw on for concurrency purposes. The vesting period for these trips runs until 2015. However, due to the downturn in the economy, they have not used up all the vested trips, and so the proposed ordinance also requests that the vesting period be extended an additional 20 years or until all the trips are used up, whichever comes first. It is important to note that they are note asking for any additional trips, just an extension of the period of time by which they have to use those already vested. The Owners and the County agree that the above —. ——. aan i it ins and 2,494 peak-hour trips. 4ne for internal road capacity of 4,980 trips and 2, ooh and peak-hour trips will be vested for a period of fifteen (15) years begin with the effective date of RAC and the RAC Infrastructure Agreement. ) ¥ will notify County in writing regarding allocation of vested trips at the time of plan review and prior to final development order of each development p within the RAC. Legendary, Inc., a Florida corporation, will function as ah Owners regarding, above referenced allocation. Any Owner mae a . time, designate a substitute agent by notifying the County Planning writing with 30-days notice of change. | have attached the proposed ordinance by which the RAC boundary would be modified, as well as two drawings - one showing the areas to be added, the other showing what the RAC boundary will look like if approved. Finally, | have also included the entire RAC Infrastructure Agreement from which paragraph G, above, was excerpted. Since the Mid-Bay Bridge Authority has an interest in development in this area, we would greatly appreciate your thoughts regarding the proposed boundary amendment and vesting extension. | left a message with your associate, Cathy, along with my cell phone number which is 685-0251. | would greatly appreciate an opportunity to discuss this with you at your earliest convenience. | have a 1:00-1:30 PM meeting this afternoon and am available any time before or after that. | am also available from 7:00-7:30 AM tomorrow, and then from 12:30 onwards (I will be in a meeting from 8:00 until roughly 12:00).
