Meams, City Manager From: Michael Beedie, Engineering & Utility Services Director Date: September 27, 2011 Subject: Approval of State Setback Waiver- 233 Alconese Ave 1. BACKGROUND: 1. 1. Mr. Julian Lorant, property owner of 233 Alconese Avenue SE, applied for a submerged land lease modification to the Florida Department of Environmental Protection ( FDEP). Section 18- 21. 004( 3)( d) of the Florida Administrative Code states that all structures located in waters of the State most be set back a minimum of 25 feet from an applicant' s riparian rights line. This setback may be waived if a letter of concurrence is obtained from the affected adjacent upland riparian owner. 1. 3. The City of Fort Walton Beach owns the adjacent upland riparian rights line 2. DISCUSSION: 2. 1. The attached " Letter of Concurrence" authorizes the property owner' s riparian structure to be located within the 25 foot riparian line setback, approximately 18 feet from the riparian line shared with the City of Fort Walton Beach. 3. FINANCIAL INFORMATION: 3. 1. The setback waiver has no financial impact to the City. 4. 4.
