RESOLUTION NO. 51- 26 A RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO ENTER INTO A LEASE FOR A PERIOD OF 99 YEARS WITH AN OPTION TO RELEASE FOR AN ADDITIONAL PERIOD OF 99 !EARS FOR AN IN CONSIDERATION OF THE SUM OF ONE OOLLAR . AND THE AGREm1ENT TO USE CERTAIN PROPERTY FOR THE SOLE AND EXCLUSIVE BENEFIT OF RETARDED CHILDRED, SAID PROPERTY BEING DESCRIBED BELOW AND BEING LEASED TO OKALOOSA COUNTY ASSOCIATION FOR RETARDED CHILDREN, INC., AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a non- profit organization with a corporate charter has been formed in Okaloosa County, Florida, for the benefit of retarded children of Okaloosa County,: Florida, and WffEREAS, the following described property is owned by the City of Fort Walton Beach and not now needed for other municipal purposes, nor is there a contemplated use therefor, and WHEREAS, the City deems it proper and advisable to lease this property to theOka~ oosa County Association for Retarded Children, Inc. for their benefit, said property being described as follows: Beginning at the SW corner of the NW!, Section 14, Township 2 South, Range 24 West, thence Northerly 40 feet, more or less, to North right- of-~ of Hollywood Boulevard, thence ' East 33 feet more or less to East right-of- way of unnamed street lying between Section 14 and 15, Township 2 South, Range 24 West, to point of beginning, thence North 618 feet, thence East 622 feet, thence South 618 feet, thence West 622 feet to point of beginning, all lying in ~ of NW! of Section 14, Township 2 South, Range 24 West. WHEREAS, it will be beneficial to the use of said association provided the above des- cribed property is used exclusively and for the sole benefit of the help and assistance to retarded children, and WHEREAS, the City Council of theCity of Fort Wa~ ton Beach, deems it proper to grant a lease of said premises for 99 years with an option to re- lease for 99 years, with a provision of reverter thereon in the event the said association should fail to use said premises for the purposes for which they are intended for a period of one year by a non- profit or~anization or should assign said premises to another association which would use them for other purposes than for the benefit of retarded children. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEA.CH, FLORIDA: SECTION 1: That a lease for a period of 99 years with a reversiona~ clause providing for an a.utomatic reverter to the City in the event of an abandonment or use other than for the benefit of retarded children is hereby granted to the Okaloosa Association for Retarded Children, Inc. for a period of 99 years, with an option to lease re- for an addi tional period of 99 years, in consideration of the sum of One Dolla.r and the develop- moot of said project by said Association. SECTION 2: That the City Manager and the City Clerk are hereby authorized and directed to enter such a lease with the proper officials of said Association. SECTION 3: That this Resolution shall, because of its emergency nature, take effect immedia tely after its passage and approval by the Mayor.
