MINUTES OF SPECIAL
MEETING OF CITY COUNCIL OF FORT WALTON BEACH, FLORIDA
OCTOBER 16, 1969
I Introduction A
Hall
the
special meeting of the City Council of Fort
Walton Beach,
on
Florida, was held at the City
October 16,
following present:
1969, at 4: 45 p. m. with
Maurice McLaughlin, Mayor
Sterlyn Killingsworth
William H. Sconiers
Joseph W. Guidry
C. H. Long
George Palmer, and
City Attorney, City Clerk- Finance Director, and
City Manager.
Mayor read waiver of notice of meeting signed
by those councilmen present: " We, the under-
signed members of the City Council of the City
of Fort Walton Beach, do hereby waive notice
of time, place, and purpose of this Special
Meeting of City Council, and do hereby set
the time of said meeting as 4: 45 p. m. CDT,
Thursday, October 16, 1969, and the City Hall
Council Chamber as the place. This special
meeting was called to discuss a resolution
authorizing execution of
license agreement a
with A. G. Anderson pertaining to the location
of a traffic signal controller."
Manager explained that the request had come
through attorney Fred Estergren on behalf of
A. G. Anderson who owned the property on
which the control box was located. He said
the request was for the City to accept a
permit from A. G. Anderson to operate the
controller on his property at the intersection
of Hollywood and Beal. The survey prepared
I
by the purchaser Gulf Oil had shown the
controller to be located on Anderson' s property.
Manager said the urgency was that Anderson had
an option to sell the property and the pros-
pective buyer didn' t want it with any encroach-
ment.
City Attorney said he had mentioned two
alternatives; one you could ask the State to
relocate assuming that there is an encroach-
20G
ment and other would be for City to go on with
agreement and if ever has to be moved then it
must come back into the ROW: and could ask
the SRD to move it.
Mr. Palmer commented that State moved any
pole that had to be moved. Attorney said
he thought they would assume the responsi-
bility. City Manager asked if City assumed
title when assumed maintenance. Attorney
said no.
Mr. Long asked if it was definite that
there was an encroachment. It was suggested
that the permit might be changed to read
that permit was being granted if in fact
that the traffic controller has been found
to be on Anderson' s property by surveyor.
Mr. Long moved that Council approve the permit.
City Attorney read resolution 69- 38.
69- 38 - A RESOLUTION AUTHORIZING THE CITY
MANAGER ON BEHALF OF THE CITY OF FORT WALTON
BEACH TO EXECUTE A LICENSE AGREEMENT WITH
A. G. ANDERSON AND WIFE PERTAINING TO THE
LOCATION OF A TRAFFIC SIGNAL CONTROLLER THAT
IS INSTALLED ON THEIR PROPERTY, PROVIDING THE
EFFECTIVE DATE HEREOF.
He suggested qualifying the agreement adding
words " this agreement on the fact if the
controller is located on Anderson' s property."
Mr. Long moved that the resolution be adopted
with the suggested amendment to the agreement -
provided however, that this acceptance is
predicated on the signal controller in actuality
being located on the property of the licensor."
Motion seconded by Mr. Guidry and carried
unanimously.
Adjournment Meeting adjourned at 5: 05 p. m.
