( 904) 488- 7864 I August 3, 1993 Ms. Susan Myers, Council Member City of Fort Walton Beach Post Office Box 4009 Fort Walton Beach, FL 32549 Dear Ms. Myers: As a Fort City Council Member, you have expressed Walton Beach concern potential voting conflict involving property over a originally owned by your grandparents. You advise that the land was left to your aunt who is deceased and now belongs to your cousins do not live who in Fort Walton Beach. A vote on the purchase this of property by the City was on the agenda at your first Council meeting in April. You state that you disclosed the family history of the property and said you did not want to vote on the matter; however, you were told by the City Attorney that you were compelled to vote. Based on his advice, you voted to purchase the property for historical reasons. As the definition of " relative" contained in the voting conflicts statute, Section ll2. 3l43( l) ( b), does not include either one' s aunt or cousins, and as you have indicated that you have no personal interest in the property, you were not presented with a voting conflict in this matter and you were correct to follow the advice of the City Attorney and to vote. Regarding your questions about voting requirements, the Commission has concluded that a pUblic officer should not abstain from voting on matters coming before his board unless there is or appears to be a conflict of interest under one of the provisions of the Code of Ethics.
