Engineering/LJtilities Services Director, presented background information on the
item, explaining that the parking lot at the subject property had been repaved without the
required building permit or approvals, and that the Code Enforcement Board issued an Order I
and Order II, which called for the imposition of fines including the administrative fee of$ 650.00,
which has since been paid.
Mr. Bolduc continued that due to the applicant being out of state for medical reasons, the ability
to reply to notices was greatly affected and the owner feels that since the property was
maintained and under improvement, consideration should be given when evaluating the gravity
of the violation.
Mr. Bolduc advised that while evaluating the case using the criteria located in the City's Code of
Ordinances, Staff finds that the release of the lien on the property located at 186 Miracle Strip
Parkway SE is an appropriate action at this time, while leaving all other liens in place.
The City Attorney advised that, according to State Statute, a lien is attached to all properties
owned by a property owner regardless of whether they are in compliance.
The vote on the motion to authorize the Mayor to execute a Release of Lien(s) for the property at
186 Miracle Stri p P ar kwa y SE within three 3 day s o f this
' meeting for the administrative fee
amount of$650. 00 per the City's Code of Ordinances carried unanimousl Y.
