CONT) comments made by Mr. Tucker in their deliberation as not
being relevant. As there was no one else from the public
who wished to speak, the City Attorney opened the floor for
Counci 1 to ask any questions they may have regarding the
proceedings.
The Mayor Pro Tem stated his displeasure at the
quasi- judicial proceedings stating it is difficult when
Council cannot talk to the citizens who put them in office.
The City Attorney asked for closing statements from the
interested parties.
Mr. Dewre11 stated in his closing argument that the project
meets all the objecti ve cri teri a as it rel ates to
compat i bi 1 ity , and therefore the recommendation of the CRA
should be overturned and the project approved as requested.
Mr. Lorenz, in his closing argument, stated the CRA did its
job by recommending disapproval of the project because it
negatively impacts the surrounding neighborhoods, and
remarked that when both sides of the story are heard, there
is substanti a 1, competent evi dence that the project shoul d
not be approved.
Mr. Theriaque began his closing argument by expressing Mr.
Murtha' s concern on the quasi- judicial system. He cited the
only independent consultant to study the issue was Ms.
Easley, and it was her determination alone that the project
was not compatible. Mr. Theriaque admitted Dolphin Bay is a
fine project, but it is not appropriate for this location.
He reminded that he represents the residents of the
nei ghborhood and they wi 11 be adversely effected by thi s
project. Mr. Theri aque requested that Counci 1 fi nd thi s
project not appropri ate for thi s 1 ocati on and deny
application.
Mrs. Wyni negar moved to approve the developers request by
finding that the Dolphin Bay Project does not unduly
negat i ve 1 y impact the exi st i ng nei ghborhoods nea r the
project; the project is compatible ~ th the existing
nei ghborhood; and the project proposa 1 comp 1 i es ~ th the
ordinances of the City and the application is approved.
Motion was seconded by Mr. Campbell and it carried by a vote \
of 3 to- 2 ~ th Carnathan. Campbell. and Wyninegar in favor
and Watson and Murtha opposed ( Gibson and Covey abstained).
ADJOURNMENT There bei ng no further busi ness, the meeti ng adjourned at
