A Resolution to be Entitled:
A RESOLUTION RELATING TO THE ACQUISITION OF
AN EASEMENT ACROSS CERTAIN PROPERTY, DECLARING
SUCH EASEMENT TO : BE FOR THE PURPOSE OF EXTEND-
ING THE SEWER LINES OF THE CITY OF FORT WALTON
BEACH; DECLARING THE SAME ~ O BE A NECESSITY
FOR THE PUBLIC USE AND BENEFIT; AND AUTHORIZING
AND DIRECTING THE CITY ATTORNEY TO TAlE ALL
S1'EPS AND INSTITUTE ANY AND ALL LEGAL ACTIONS
AS MAY BE NECESSARY, INCLUDING CONDEMNATION
PROCE D: rNGS, FOR THE PURPOSE OF ACQUIRING SUCH
EASEMENT; AND DECLARING THAT THERE IS AN IMMED-
IATE NEED FOR THE ACQUISITION OF SUCH EASEMENT
AND THAT THE CITY ATTORNEY IS AUTHORIZED AND
DIRECTED TO FILE IN THE CONDEMNATION PROGEEDINGS
A DECLARATION OF TAKING IN ORDER THAT THE CON-
STRUCTION OF SAID SEWER EXTENSION MAY : BE CON-
TINUED IN AN EXPEDITIOUS AND ORDERLY MANNER;
AUTHORIZING THE CITY CLERK AND THE CITY MANAGER
TO DEPOSIT INTO THE REGISTRY OF THE COURT OR PAY
TO NECESSARY INTERESTED PARTIES ANY SUMS OF
MONEY AS MAY BE REQUIRED FOR THE PURPOSE OF
ACQUIRING SAID EASEMENT WHEN CALLED UPONro DO
SO, AND PROVIDING THAT THIS RESOLUTION SHALL TAKE
EFFECT IMMEDIATELY.
WHEREAS, it has become necessary to extend the sewer lines
of the City of Fort Walton Beach across that certain parcel
of land hereinafter described, and,
WHEREAS, an attempt has been made to obtain an easement
across said land from the owner thereof and such attempts to
attain said easement have been unsuccessful, and,
WHEREAS, it is for the public use and benefit that such
sewer line be extended, and in order to obtain such easement
it is necessary that such easement be obtained;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WALTON BEACH, FLORIDA, as follows:
1. That there exists a necessity of obtaining an easement
across the lands hereinafter described, and that such necessity
is for the public use and benefit for the public purpose of
extending the sewer lines of the City of Fort Walton Beach.
2. That the City Attorney be, and he hereby is authorized
and directed to take any and all legal steps necessary, includ-
ing condemnation proceedings for the purpose of acquisition of
such easement.
3. That there exists an immediate urgency for the continua-
tion of construction of the sewer lines surveyed and laid out
and in view of such immediate need for such easement, the
