R.. 2nd ../, Ob y- ORDINANCE NO. 1692 AN ORDINANCE OF THE CITY OF FORT WALTON BEACH FLORIDA RELATING TO CONSUMPTION AND POSSESSION OF ALCOHOLIC BEVERAGES IN CITY PARKS; AMENDING SECTION 7. 05. 05(1), ALCOHOLIC BEVERAGES IN CITY PARKS, TO AUTHORIZE CITY MANAGER TO PERMIT TEMPORARY AUTHORIZATION OF CONSUMPTION AND POSSESSION OF ALCOHOL IN CITY PARKS; PROVIDING FOR PUNISHMENT BY GENERAL PENAL TV PROVISIONS OF THE CODE; AND SETTING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA, AS FOLLOWS: SECTION 1. AUTHORITY AND INTENT. The authority for enactment of this Ordinance is Section 166. 021, Florida Statutes ( 2006). This ordinance is intended to clarify and assert City policy regarding consumption and possession of alcoholic beverages in City Parks. SECTION 2. AMENDMENT OF SECTION 7.05. 05, PROHIBITED BEHAVIOR IN CITY PARKS Section 7. 05.05( 1) is hereby amended as follows: 7. 05.05 Prohibited Behavior No person in a park shall: 1) Alcoholic Beverages in Parks Prohibited Consume or possess any alcoholic beverage in any city park, recreational, or cultural center except when temporarily authorized to do so by the city manaaer for the purpose of special events on designated city properties. SECTION 3. PENALTY FOR VIOLATIONS Violations of this ordinance shall be punishable as provided in section 1. 05 of the Code of Ordinances. SECTION 4. EFFECTIVE DATE.
