4D ORDINANCE 1604 r lot D AN ORDINANCE OF THE CITY OF FORT WALTON BEACH, FLORIDA; RELATING TO THE ANNEXATION OF LOT 3, BLOCK F, COUNTRY CLUB ESTATES SUBDIVISION ( 628 COUNTRY CLUB AVENUE NE); PROVIDING FOR AUTHORITY; PROVIDING FOR FINDINGS OF FACT; PROVIDING FOR PROPERTY ANNEXED; PROVIDING FOR EFFECT OF ANNEXATION; PROVIDING FOR MUNICIPAL BOUNDARY; PROVIDING FOR AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA, AS FOLLOWS: SECTION I. AUTHORITY. The authority for enactment of this ordinance is Section 166.021( 1) and Section 171, 044, Florida Statutes, and Section 2 of the City Charter. SECTION II. FINDINGS OF FACT. The City Council of the City of Fort Walton Beach finds the following: A. That an application for voluntary annexation was received by the City on July LL 21, 2004, from Keith and Kimberly Brooks, owners of the property to be annexed; and, 8 B. That the applicant has provided sufficient evidence of ownership of said to be annexed; and, J U o property Q C. SECTIONSECTION 111.111. PROPERTYPROPERTY ANNEXED.ANNEXED. TheThe followingfollowing described described propertyproperty isis herebyhereby annexedannexed toto thethe CityCity ofof FortFort WaltonWalton Beach:Beach: 1-1-  Lot 3, Block F, Country Club Estates Subdivision, according to the plat thereof, as recorded in Plat Book 3 at Page 41, of the Public Records of Okaloosa County, Florida. SECTION IV. EFFECT OF ANNEXATION. A. The area annexed shall be subject to all laws, ordinances, and regulations in force in the City of Fort Walton Beach and shall be entitled to the same privileges and benefits as other parts of the City of Fort Walton Beach upon the effective date of the annexation. B. The area annexed is subject to the Okaloosa County Comprehensive Plan and zoning regulations. Said regulations shall remain in full force and effect until the area is assigned a Comprehensive Plan Future Land Use designation and is rezoned by the City of Fort Walton Beach to comply with its Comprehensive Plan. SECTION V. MUNICIPAL BOUNDARY. The Municipal boundary lines of the City of Fort Walton Beach shall hereby be amended to include the annexed property described herein before and in Exhibit "B ", attached and made a part hereof by reference, as a metes and bounds description. A map of the annexed area is attached hereto as Exhibit "A" and made a part hereof by reference. SECTION VI. EFFECTIVE DATE. I. Applicant represents and warrants that: a.) Applicant is the owner and holder in fee simple of the Property to be Annexed which is described as follows: Lot 3, Block F, Country Club Estates Subdivision, according to the plat thereof as recorded in Plat Book 3, Page 41, of the Public Records of Okaloosa County, Florida. b.) Applicant has applied by written application to the City for annexation into the City the Property to be Annexed. II. City represents and warrants that: a.) The Fort Walton Beach City Council has authorized the application be processed and that the City Manager negotiate and sign this Agreement on behalf of the City. b.)
