adjunct to their
development. The resulting inconsistent pattern of sidewalk development along public
streets has hindered the development of alternative pedestrian transportation,
especially in the Redevelopment Area.
It is standard practice to require construction of sidewalks in th~ public street right-of-
ways adjacent to new development and redevelopment in areas of a city zoned for
multifamily, commerciar or industrial uses.
Section 20-755, LDC, the Codified version of Ordinance 1346, specifies when and
where sidewalks are required. There are also provisions for maintenance by the
adjacent property owners.
Since adoption of Ordinance 1346 in 1998, the City has adopted several new mixed
use and commercial zoning districts and rezoned substantial areas within the City to
these new districts. In order to continue the a uniform public policy of requiring new
development and redevelopment to construct sidewalks along streets where
multifamily, commercial and industrial land uses occur, the provisions of Section 20-
755 will requirement amendment.
A summary of the changes to the requirements for sidewalks as set out in the draft
Ordinance 1558 are as follows:
Brooks Street in CRA: Add requirements for sidewalks five feet in width
on the south side and seven feet on the north side ( matches existing
private/public sidewalk development)
Multiple family djstricts: Sidewalks shall be five feet in width.
No change = R- 2, R- 2A, DR-3 and PUD districts (intended for
multiple family use)
Delete= R- NC, DR-4 and DR- 5
Commerciallindustrial districts: Sidewalks shall be six feet in width on
streets designated in the comprehensive plan as collector streets and
eight feet on streets designated as minor or major arterials.
No change= C- 1, C- 2, M- 1, M- 2, P- 1, P- 2 and PUD districts intended
for use( commercial), commercial or industrial use.
mixed..
Delete= DC- 3, DC-4, R- NC, DR-5
New Districts= HC commercial district, and YC, MUCC- 1, MUCC- 2,
MUMS, and MUW mixed use district
Public lands districts: Sidewalk width requirements shall be determined by
the Public Works Director based on the specific needs of the public facility
being developed or redeveloped, but in no case shall sidewalk be less
than four feet in width.
New Districts: CF, EF and OS
We solicited comments from both the Public Works Department and other CDS staff
and incorporated the suggested editorial changes.
The City Attorney provided a legal opinion on the form and content of the draft
ordinance which have also been incorporated into the draft presented to the MPB for
consideration.
RECOMMENDATION:
Staff recommends that the Municipal Planning Board recommend approval of the
changes to Section 20-755 and recommend that City Council adopt Ordinance 1558.
