A RESOLUTION AUTHORIZING THE CITY MANAGER ON
BEHALF OF THE CITY OF FORT WALTON BEACH TO
EXECUTE A LEASE WITH NICHOLAS MAKOW PROVIDING
THE EFFECTIVE DATE HEREOF.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WALTON BEACH, FLORIDA:
SECTION I. The City Manager, on behalf of the
City of Fort Walton Beach, is hereby authorized to execute
the attached lease with Nicholas Makow.
SECTION II. This resolution being of administrative
nature shall take full force and effect immediately upon
its passage and approval by the Mayor.

Here comes now the CITY OF FORT W~LTON BEACH,
hereinafter referred to as the " Lessor", ~ d NICHOLAS ~ ffiKOW,
hereinafter referred to as the " Lessee", and in consideration
of mutual covenants made by either party, and hereby agree as
follows:
1. The Lessor hereby grants to the Lessee the right
to use a portion of the land the Lessor fu~d
owns uses for a
golf course for the purpose of permitting the Lessee to establish
a
facility for the preparation and of
serving such foods as
sandwiches, coffee and cold drinks.
2. That the Lessee shall operate the facility in
accord~ ce with all City, County and State regulations pertaining
to the handling of food and including installation of restroom
facilities.
3. The term of this agreement for permitting the Lessee
to operate a concession shall be for of
a period five years from
the date hereof and the Lessee shall have the option to renew
for an additional five year term on the terms and
same conditions.
4. That no rent shall be paid by the Lessee to the
Lessor.
5. Each party shall have the right to terminate this
agreement by giving six months written notice thereof to the
other.
6. The facilities shall be operated in accordance with
the attached bid response of the Lessee. - The Lessee shall connect
to and use City sewer, water, and electric at the
power golf
course, and the Lessee shall be responsible for all utility bills
incurred by the Lessee.
7. No liquor or alcoholic beverages shall be sold on
the premises at any time.
8. The facilities shall be kept in a s~ itary condition
at all times.
